Գագիկ Ծառուկյանի անունից ՄԻԵԴ ներկայացված երկու գանգատներն էլ ստացվել են Դատարանի կողմից

Տեղեկացնում ենք, որ Գագիկ Ծառուկյանի անունից Մարդու իրավունքների եվրոպական դատարան ներկայացված երկու գանգատներն էլ ստացվել են Դատարանի կողմից։
 
Գանգատներով բարձրացվել են Մարդու իրավունքների եվրոպական կոնվենցիայի 3-րդ, 5-րդ և 18-րդ հոդվածներով, ինչպես նաև Կոնվենցիայի թիվ 7 արձանագրության 4-րդ հոդվածով երաշխավորված իրավունքների խախտման հարցեր։ Դրանք վերաբերում են Գագիկ Ծառուկյանի նկատմամբ իրականացվող ապօրինի և քաղաքական շարժառիթներով պայմանավորված քրեական հետապնդմանը, ազատությունից ապօրինի զրկելուն, նրա նկատմամբ ցուցաբերված անմարդկային ու նվաստացուցիչ վերաբերմունքին, քրեաիրավական սահմանափակումներն իրենց համար նախատեսված իրավաչափ նպատակից շեղված՝ քաղաքական նպատակներով կիրառելուն, ինչպես նաև նույն արարքների կապակցությամբ կրկնակի քրեական հետապնդման արգելքի խախտմանը։
 
Ներկայացված փաստերը, ներպետական դատավարությունների նյութերը, քրեական վարույթների ժամանակագրությունը և պետական բարձրաստիճան պաշտոնատար անձանց հրապարակային հայտարարությունները կազմում են փոխկապակցված ապացույցների ամբողջություն։ Դրանք ցույց են տալիս, որ քրեական արդարադատության համակարգն օգտագործվել է ոչ թե օրինական քրեաիրավական նպատակների, այլ քաղաքական հակառակորդին հետապնդելու, մեկուսացնելու և հանրային ու քաղաքական գործունեությունից հեռացնելու համար։
 
Քաղաքական հաշվեհարդարը չի դառնում իրավաչափ միայն այն պատճառով, որ ձևակերպվում է քրեական վարույթի որոշումներով։ Քրեական դատավարության արտաքին ձևականությունները չեն կարող քողարկել հետապնդման իրական նպատակը։
 
Երկու գանգատներով էլ ՄԻԵԴ-ից խնդրել ենք դրանց տրամադրել առաջնահերթություն՝ Դատարանի կանոնակարգի 41-րդ կանոնին համապատասխան։ Գանգատները վերաբերում են Կոնվենցիայի հիմնարար իրավունքներին, այդ թվում՝ անձի ազատությանը, ինչպես նաև պետական իշխանության կողմից քրեական հետապնդման մեխանիզմների քաղաքական նպատակով չարաշահմանը։ ՄԻԵԴ-ի ձևավորված մոտեցումը վկայում է, որ նման բնույթի՝ քաղաքական շարժառիթներով ազատությունից զրկման և Կոնվենցիայի 18-րդ հոդվածի խախտման վերաբերյալ գործերը ստանում են առաջնահերթ ընթացք և սովորաբար կոմունիկացվում են սեղմ ժամկետներում։
 
Մենք վստահ ենք, որ գանգատների լիարժեք քննության արդյունքում Մարդու իրավունքների եվրոպական դատարանը կարձանագրի Գագիկ Ծառուկյանի՝ Կոնվենցիայով պաշտպանվող իրավունքների խախտումները։ Ներկայացված իրավական և փաստական նյութերի համակցությունը, մեր գնահատմամբ, որևէ ողջամիտ տեղ չի թողնում այն պնդման համար, թե տեղի ունեցողը սովորական կամ քաղաքականապես չեզոք քրեական հետապնդում է։
 
Այս գործերը վերաբերում են ոչ միայն Գագիկ Ծառուկյանի անհատական իրավունքներին։ Դրանք վերաբերում են Հայաստանում քրեական արդարադատությունը քաղաքական հաշվեհարդարի գործիք դարձնելու անընդունելի գործելակերպին, որի համար պետությունն անխուսափելիորեն կրելու է միջազգային իրավական պատասխանատվություն։
