Ինչ պատժամիջոցներ են նախատեսվում ոչ սթափ վիճակում մեքենա վարելու համար

Օրենսդրությունը տարբեր պատժամիջոցներ է նախատեսում ոչ սթափ վիճակում մեքենա վարելու համար։

Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի 126-րդ հոդվածի համաձայն՝ անձը համարվում է ոչ սթափ վիճակում գտնվող, եթե նրա՝

մեկ լիտր արյան մեջ մաքուր ալկոհոլի պարունակությունը 0.2 գրամից ավելի է,
կամ մեկ լիտր արտաշնչած օդի մեջ մաքուր ալկոհոլի պարունակությունը 0.1 միլիգրամից ավելի է,
կամ արյան կամ մեզի մեջ առկա է թմրամիջոց կամ հոգեմետ (հոգեներգործուն) նյութ։

Եթե վարորդը միայն ալկոհոլի ազդեցության ներքո է, և դեպքը չի համապատասխանում օրենքով նախատեսված ավելի ծանր դեպքերին, սահմանվում է տուգանք՝ նվազագույն աշխատավարձի 29-ապատիկի չափով, ինչպես նաև կիրառվում է 5 տուգանային միավոր։ Ընդհանուր օգտագործման տրանսպորտային միջոցի կամ թեթև մարդատար-տաքսի վարորդը ալկոհոլի ազդեցության տակ է վարելու դեպքում վարորդը կարող է 6 ամսով զրկվել տրանսպորտային միջոցներ վարելու իրավունքից։

Եթե վարորդի մեկ լիտր արյան մեջ մաքուր ալկոհոլի պարունակությունը գերազանցում է 1 գրամը, կամ մեկ լիտր արտաշնչած օդում՝ 0.5 միլիգրամը, նախատեսվում է վարորդական իրավունքից զրկում՝ մեկ տարի ժամկետով։

Արյան կամ մեզի մեջ թմրամիջոցի կամ հոգեմետ նյութի առկայության դեպքում վարոդը 2 տարով զրկվում է տրանսպորտային միջոցներ վարելու իրավունքից։

Սթափության վիճակը ստուգելու զննությունից խուսափելու դեպքում վարորդը 2 տարով զրկվում է տրանսպորտային միջոցներ վարելու իրավունքից։

Եթե առաջին մասով նախատեսված ոչ սթափ վիճակում վարելը կրկնվում է վարչական տույժ նշանակելուց հետո մեկ տարվա ընթացքում, սահմանվում է վարորդական իրավունքից մեկ տարի ժամկետով զրկում։

Արտաշնչած օդում ալկոհոլի պարունակությունը կարող է որոշվել տեխնիկական միջոցով կամ բժշկական փորձաքննությամբ։ Արյան մեջ ալկոհոլի, ինչպես նաև արյան կամ մեզի մեջ թմրամիջոցի կամ հոգեմետ նյութի առկայությունը որոշվում է բժշկական փորձաքննությամբ։ Մեքենա վարելուց առաջ ալկոհոլ օգտագործելը կարող է հանգեցնել ոչ միայն տուգանքի, այլև վարորդական իրավունքից զրկվելու։
