TikTok-ն ԱՄՆ-ին 400 մլն դոլար կվճարի՝ երեխաների գաղտնիության պաշտպանությունը խախտելու գործով

TikTok տեսահարթակը և դրա մայր ընկերությունը՝ ByteDance-ը, համաձայնել են ԱՄՆ կառավարությանը 400 մլն դոլար վճարել՝ երեխաների գաղտնիության պաշտպանության մասին օրենքի խախտման գործը կարգավորելու համար։ Սա ԱՄՆ-ում նմանատիպ խախտումների համար երբևէ նշանակված ամենախոշոր տուգանքներից մեկն է, հայտնում է BBC News-ը։
TikTok-ի և ByteDance-ի դեմ հայցը ԱՄՆ արդարադատության նախարարությունը ներկայացրել էր 2024 թվականին՝ Ջո Բայդենի վարչակազմի օրոք։ Ամերիկյան իշխանություններն ընկերություններին մեղադրել են 13 տարեկանից փոքր միլիոնավոր օգտատերերի մասին «հսկայական ծավալի տվյալներ» հավաքելու մեջ՝ առանց ծնողների անհրաժեշտ համաձայնության, ինչը խախտում է 2000 թվականից գործող Երեխաների առցանց գաղտնիության պաշտպանության մասին օրենքը (COPPA)։
«Այսօր երեխաներն ու ծնողները ավելի լավ են պաշտպանված, քան այս գործի սկզբում», — հայտարարել է ԱՄՆ գլխավոր դատախազի օգնական Բրեթ Շումեյթը։
Համաձայնագրի պայմաններով, TikTok-ը և ByteDance-ը անմիջապես կվճարեն արդարադատության նախարարությանը 300 մլն դոլար։ Եվս 100 մլն դոլար ընկերությունները կփոխանցեն այն բանից հետո, երբ ԱՄՆ կառավարությունը չեղարկի Դաշնային առևտրի հանձնաժողովի հետ 2019 թվականի համաձայնագիրը, որը կնքվել էր TikTok-ի կողմից երեխաների տվյալների պաշտպանության օրենքը խախտելու գործով։
TikTok-ի նախորդը՝ Musical.ly հավելվածը, այն ժամանակ պարտավորվել էր վճարել 5,7 մլն դոլարի չափով տուգանք և ստանալ ծնողների համաձայնությունը՝ 13 տարեկանից փոքր երեխաների կողմից ծառայությունից օգտվելու համար։
ԱՄՆ արդարադատության նախարարությունը չի հայտնել TikTok-ի նկատմամբ որևէ լրացուցիչ միջոցի մասին՝ նոր համաձայնագրի շրջանակում։ Միևնույն ժամանակ գերատեսչությունը նշել է, որ հայցի ներկայացումից ի վեր հարթակը էականորեն փոխվել է, այդ թվում՝ սեփականության կառուցվածքի, գաղտնիության քաղաքականության և անչափահաս օգտատերերի համար վերահսկողության գործիքների մասով։
Երբ հայցը ներկայացվել էր, ամերիկյան իշխանությունները հայտարարում էին, որ TikTok-ից օգտվում էին ավելի քան 170 մլն դեռահասներ, իսկ հարթակն ինքնին ուղղված էր նաև երեխաներին։ Ըստ արդարադատության նախարարության վարկածի, ընկերությունը ոչ բավարար արդյունավետությամբ էր ստուգում օգտատերերի տարիքը և չէր ստանում ծնողների համաձայնությունը՝ 13 տարեկանից փոքր երեխաների կողմից ծառայությունից օգտվելու համար։
Գործի կարգավորումը վերաբերում է TikTok-ի գործունեությանը Չինաստանում և անմիջականորեն կապված չէ հարթակի ամերիկյան բիզնեսը դրա սկզբնական չինական կառուցվածքից առանձնացնելու հետ։ Անցյալ տարի TikTok-ի ամերիկյան գործունեությունը անցել է ներդրողների կոնսորցիումի վերահսկողության տակ, որին պատկանում է ընկերության 81%-ը։ ByteDance-ի բաժինը կազմում է 19%։
Մյուս խոշոր տեխնոլոգիական ընկերությունները ևս արդեն տուգանվել են ԱՄՆ-ում՝ COPPA-ի խախտման համար։ 2019 թվականին YouTube-ը համաձայնել էր վճարել 170 մլն դոլար, իսկ 2022 թվականին Epic Games-ը՝ 275 մլն դոլար։
