Երեմ Սարգսյանի հետ տեղի ունեցած իրադարձությունները, բնականաբար, անպատասխան չթողեցինք, հանդես եկանք բացարկի միջնորդությամբ ոչ միայն քննիչին, քննչական խմբի ղեկավարին, այլ ամբողջ քննչական խմբին: Այս մասին լրագրողների հետ զրույցում ասել է «Բարգավաճ Հայաստան» կուսակցության առաջնորդ Գագիկ Ծառուկյանի փաստաբանական խմբի անդամ Էմին Խաչատրյանը:
«Ամբողջ քննության ընթացքում տեսած տարաբնույթ ապօրինությունների մեջ միամտություն կլինի արդարություն փնտրելը, հետևաբար՝ առնվազն այս փուլում պետք է արձանագրենք թե՛ տեղի ունեցած ապօրինությունը, թե՛ այն հանգամանքը, որ հնարավոր ու անհնարին բոլոր մեթոդներով պարոն Ծառուկյանին զրկում են արդյունավետ պաշտպանության իր իրավունքից, իսկ դրանք ամրագրված են և՛ Սահմանադրությամբ, և՛ մնացած մյուս օրենքներով։
Այս ամենը մենք պետք է արձանագրենք, սրա մասին պետք է չլռենք, պետք է խոսենք ու նաև իրավական գործընթացով, չնայած՝ պարոն Ծառուկյանի նկատմամբ տեղի ունեցան ոչ իրավական գործընթացներ»,-նշել է նա։
Հարցին՝ բացի փաստաբան Երեմ Սարգսյանին վարույթից հեռացնելուց, այլ ի՞նչ հիմքեր կային բացարկի, Խաչատրյանը պատասխանել է.
«Հիմա գործի մանրամասներից չեմ խոսի, բայց հենց մեղադրանքից սկսած, որ պարոն Ծառուկյանի նկատմամբ առաջադրվել է այս ապօրինի մեղադրանքը, այսինքն՝ պարոն Ծառուկյանն այս գործով պետք է լիներ առնվազն տուժող, բայց նրան տրվել է մեղադրյալի կարգավիճակ:
Բացարկի քննարկումը, ինձ թվում է կկատարվի սահմանված ժամկետում, որովհետև քննչական մարմինը չէ քննելու բացարկի միջնորդությունը։ Ես կարծում եմ՝ այս դեպքում շատ արագ կլինի պատասխանն ու, բնականաբար, բացարկը կմերժվի, բայց դա մեզ չի խանգարում, որպեսզի մենք արձանագրենք տեղի ունեցած ապօրինությունը»,-մանրասմանել է փաստաբանը:
Նա տեղեկացրել է՝ առերեսումը, հենց ուզում էին շարունակել, հանդես եկա հայտարարությամբ՝ բացարկի միջնորդությամբ, հետևաբար, նաև դրա հիմքով դադարեցվեց:
Հարցին՝ Գագիկ Ծառուկյանն անդրադարձել է մեղադրանքին, փաստաբանն ասել է.
«Շատ կարճ ու հստակ իր դիրքորոշումը հայտնեց, որ շինծու գործ է ու կատարվում է միակողմանի քննություն, հետևաբար՝ ինքն էլ համաձայն էր մեր դիրքորոշման հետ և քանի դեռ բացարկի հարցը որոշված չէ, որևէ այլ գործողության մասնակցելը իմաստազուրկ է»-նշել է Էմին Խաչատրյանը։
Հիշեցնենք, որ ավելի վաղ հայտնել էինք՝ առերեսումը սկսելուց առաջ որոշում է կայացվել ԲՀԿ առաջնորդ Գագիկ Ծառուկյանի փաստաբանական խմբի անդամ Երեմ Սարգսյանին հեռացել վարույթից:
