Հայաստանում կենսաթոշակառուների համար նոր հնարավորություններ են բացվում։ Մասնավորապես, պետությունը ներդնում է հետադարձ հիփոթեքի ինստիտուտը, որի համաձայն կենսաթոշակառուն կարող է իր տունը հանձնել բանկին և մինչև կյանքի վերջ ամսական գումար ստանալ։ Ի՞նչ պայմաններ են գործելու, ինչպե՞ս է հաշվարկվելու այդ ամսական գումարը, կենսաթոշակառուները ինչպե՞ս են պաշտպանված լինելու, ի՞նչ երաշխիքներ են գործելու․ այս և այլ հարցերին «Արմենպրես»-ի մամուլի սրահում հրավիրված ասուլիսում անդրադարձավ ՀՀ կադաստրի կոմիտեի ղեկավարի տեղակալ Նանե Ղազարյանը։

«Հետադարձ հիփոթեքը վարկային նոր պայմանագրի տեսակ է, որն ունի հստակ կարգավորումներ։ Կենսաթոշակային տարիքի քաղաքացիները, եթե կունենան սեփականության իրավունքով իրենց պատկանող բնակելի նշանակության շինություն և ցանկություն կունենան ստանալ վարկավորում, ապա կկարողանան իրենց գույքը գրավադրել և պարբերաբար վճարումներ ստանալ բանկից, վարկային կազմակերպությունից»,-ասաց Նանե Ղազարյանը։

Նրա խոսքով՝  սա լինելու է լրացուցիչ եկամտի աղբյուր կայուն վճարումների տեսքով, քաղաքացին չի կորցնելու իր բնակության վայրը, բնակարանի նկատմամբ իրավունքը։

«Այսինքն՝ քաղաքացին շարունակելու է իր տանը բնակվել, ինչպես նախկինում։ Այդ ընթացքում բանկը չի կարողանալու այն տնօրինել կամ գույքի հետ կապված որևէ գործարք իրականացնել։ Եվ ամեն ամիս բանկը որոշակի գումար է տրամադրելու։ Քանի դեռ քաղաքացին ողջ է, բանկը չի կարող գույքը տնօրինել»,-ասաց Նանե Ղազարյանը։

Քաղաքացու մահից հետո, եթե ժառանգները կցանկանան մինչ այդ վճարած գումարը մարել, ապա այդ հնարավորությունը կտրվի ու անշարժ գույքը հետ վերցնելու տարբերակ կլինի։ Եթե ոչ, ապա գույքը կանցնի բանկին։ Ինչ վերաբերում է սեփականատիրոջը պարբերաբար վճարվող գումարի չափին, ապա Նանե Ղազարյանը նշեց, որ դա կախված է գույքի արժեքից, գտնվելու վայրից։ 

Նանե Ղազարյանն ընդգծեց, որ սա պարտադիր պայման չէ, այլ հնարավորություն է կենսաթոշակառուների համար։ Նրանք միայն իրենց ցանկության դեպքում կարող են դիմել բանկերին։ Վերջիններս էլ, ճկուն լինելով, տարբեր առաջարկներ կներկայացնեն, քաղաքացին էլ կարող է ընտրել։

Նախագիծն ԱԺ-ում է, նախատեսված կարգով ընդունվելու դեպքում գործնականում քաղաքացիները կարող են օգտվել այդ հնարավորությունից 2027 հունվարի 1-ից։

Պետությունը նաև ներդնում է ամուսնու բացառիկ սեփականության իրավունքի ինստիտուտը։ Գործող կարգավորմամբ՝ ամուսնության ընթացքում ձեռք բերված գույքը համարվում է ամուսինների ընդհանուր համատեղ սեփականություն։ Ամուսիններից մեկի մահից հետո գույքի կեսը պատկանում է ողջ մնացած ամուսնուն, իսկ մյուս կեսը ներառվում է ժառանգական զանգվածում և բաշխվում օրենքով սահմանված ժառանգների միջև։ Առաջարկվող կարգավորմամբ՝ ամուսինները փոխադարձ համաձայնությամբ հնարավորություն կունենան գույքին տալ հատուկ կարգավիճակ, որը Կադաստրի կոմիտեում կգրանցվի որպես ամուսնու բացառիկ սեփականության իրավունք։ Մեկ ամուսնու մահից հետո ողջ մնացած ամուսինը հնարավորություն կունենա ամբողջությամբ դառնալու գույքի միանձնյա սեփականատերը։ Գույքը ժառանգական զանգվածի մեջ կներառվի միայն երկու ամուսինների մահից հետո։
