Հանրապետական ընտրություններին մասնակցելու ընտրական իրավունք ունեն միայն ՀՀ քաղաքացիները, այս մասին պարզաբանում է տարածել ՆԳՆ-ն։

«Ղարաբաղից տեղահանված սիրելի՛ հայրենակիցներ,

Երեկվանից սոցիալական մեդիայի տիրույթում տարածվել է տեղահանված անձանց ընտրական իրավունքին վերաբերող մոլորեցնող տեղեկատվություն առ այն, որ առանց ՀՀ քաղաքացիության համար դիմելու և ստանալու հնարավոր է ձեռք բերել ընտրական իրավունք և ընդգրկվել ընտրողների ցուցակներում, ինչը չի համապատասխանում իրականությանը։

ՀՀ Սահմանադրության և Ընտրական օրենսգիրք սահմանադրական օրենքի համաձայն՝ համապետական ընտրություններին մասնակցելու ընտրական իրավունք ունեն 18 տարին լրացած ՀՀ քաղաքացիները։ Ղարաբաղից տեղահանված մեր հայրենակիցները վերցվել են ՀՀ պաշտպանության ներքո, ձեռք բերել ժամանակավոր պաշտպանության՝ փախստականի կարգավիճակ։ Հետևաբար, ս.թ. հունիսի 7-ին ԱԺ ընտրություններին մասնակցելու իրավունք ձեռք բերելու միակ ճանապարհը ՀՀ քաղաքացիություն ստանալն է՝ ընտրական իրավունքի ձևավորման շրջանակում ՀՀ քաղաքացի լինելու առանցքային չափանիշը բավարարելու համար։

Հիշեցնում ենք, որ ներկա պահին մեր տասնյակ հազարավոր հայրենակիցները ստացել են ՀՀ քաղաքացիություն և կարող են մասնակցել համապետական ընտրություններին։

Տարածվող գրառումներում, տեսանյութերում իրականության չհամապատասխանող էական փաստերից է նաև Վարչական դատարանի կողմից կայացված և ուժի մեջ մտած երեք դատական ակտերի վկայակոչումը։ Վարչական դատարանի կողմից, որն իրավասու է նման հարցեր քննել, այդպիսի վճիռներ չկան։

Տեղեկացնում ենք, որ վճիռները կայացվել են Քաղաքացիական դատարանի կողմից:

Ներքին գործերի նախարարության կողմից դրանք բողոքարկվել են Վերաքննիչ դատարան՝ հաշվի առնելով այն հանգամանքը, որ այս գործերի շրջանակում դատարանը չի անդրադարձել քաղաքացիության ինստիտուտի բովանդակությանը, ինչն առանցքային է ընտրական իրավունքի տեսանկյունից, չի երաշխավորել ՆԳՆ միգրացիայի և քաղաքացիության ծառայության ծանուցումը կամ չի պահպանվել գործին վերաբերելի նյութեր ներկայացնելու պատասխանողի իրավունքը։ Արդյունքում, դրանք ՆԳՆ-ի կողմից բողոքարկվել են ընդդատության կանոնների և դատավարական այլ նորմերի խախտման հիմքով։ Հատուկ անդրադարձ է կատարվել նաև քաղաքացիության ինստիտուտին։

Հորդորում ենք հանրության շրջանում մոլորեցնող տեղեկություններ չներկայացնել, մեր հայրենակիցներին չներգրավել ոչ իրավաչափ և անօգտակար գործընթացներում»,-ասված է հայտարարության մեջ։
