Անձնական տվյալների պաշտպանության գործակալությունը նախընտրական շրջանում ստացվող ահազանգերի կապակցությամբ հիշեցնում է, որ քաղաքացիներին նախընտրական թեմաներով զանգեր, կարճ հաղորդագրություններ, էլեկտրոնային նամակներ կամ այլ ուղիղ հաղորդակցություն իրականացնելը պետք է կատարվի բացառապես օրինական հիմքով և անձնական տվյալների պաշտպանության պահանջների պահպանմամբ։ Այս մասին հայտնում են ՀՀ Արդարադատության նախարարությունից։
«Վերջին շրջանում ստացվում են ահազանգեր այն մասին, որ որոշ քաղաքական ուժեր կամ դրանց հետ առնչվող անձինք քաղաքացիներին և իրավաբանական անձանց ուղարկում են նախընտրական բովանդակությամբ զանգեր, հաղորդագրություններ և փոստային նամակներ։ Հատկապես մտահոգիչ են այն դեպքերը, երբ տվյալ անձինք նախկինում որևէ կապ չեն ունեցել համապատասխան ուժերի հետ, չեն տրամադրել իրենց կոնտակտային տվյալները այդ նպատակով օգտագործելու համար և տեղեկացված չեն, թե իրենց անձնական տվյալները որտեղից և ինչ եղանակով են ձեռք բերվել։
Գործակալությունը շեշտում է, որ անձնական տվյալների, այդ թվում՝ հեռախոսահամարների, էլեկտրոնային փոստի հասցեների և այլ կապի միջոցների օգտագործումը նախընտրական նպատակներով չի կարող իրականացվել կամայական կերպով։ Անթույլատրելի է անձնական տվյալների հավաքումը, օգտագործումը կամ փոխանցումը, եթե բացակայում է դրա օրինական հիմքը, իսկ տվյալների սուբյեկտը տեղեկացված չէ իր տվյալների աղբյուրի, օգտագործման նպատակի և հիմքերի մասին։
Առանձնակի ուշադրության է արժանի նաև այն հանգամանքը, որ իրավաբանական անձանց, մասնավորապես՝ անհատ ձեռնարկատերերին ուղարկվող հաղորդակցություններում ևս կարող են օգտագործվել նույնականացնող կամ կապի տվյալներ, որոնց մշակումը նույնպես պետք է համապատասխանի օրինականության և համաչափության պահանջներին։
Կոչ ենք անում բոլոր քաղաքական ուժերին, նախընտրական շտաբներին, նրանց անունից գործող անձանց, ինչպես նաև տվյալների հնարավոր մշակողներին՝ խստորեն պահպանել անձնական տվյալների պաշտպանության օրենսդրության պահանջները և զերծ մնալ այնպիսի գործողություններից, որոնց դեպքում անհայտ է տվյալների ծագումը, բացակայում է օրինական հիմքը կամ անձը ողջամտորեն չի կարող ակնկալել նման հաղորդակցություն ստանալ։
Միաժամանակ քաղաքացիներին և անհատ ձեռնարկատերերին կոչ ենք անում նման դեպքեր արձանագրելու դեպքում հնարավորինս պահպանել ստացված զանգերի, հաղորդագրությունների կամ նամակների վերաբերյալ տվյալները և համապատասխան ուսումնասիրություն իրականացնելու նպատակով դիմել Անձնական տվյալների պաշտպանության գործակալություն՝ ք. Երևան, Կոմիտաս 54Բ հասցեով, կամ նամակ ուղարկել [email protected], [email protected] էլեկտրոնային հասցեներին»,-ասված է հայտարարության մեջ։
