Դեռևս 2025 թվականի հունվարի 24-ին «Հայաստանը ես եմ» նախաձեռնությունը պաշտոնապես դիմել էր ՀՀ կառավարությանը՝ առաջարկելով վերանայել ՀՀ Քրեական օրենսգրքի 290-րդ հոդվածը։ Առաջարկը հստակ էր՝ սահմանել քրեական պատասխանատվության շեմ՝ 50 միլիոն դրամի չափով, ինչպես նաև օրենքում ամրագրել, որ պատասխանատվությունից ազատման հիմք կարող է հանդիսանալ չվճարված հարկերի, տուրքերի կամ այլ վճարների ամբողջական մարումը՝ առանց տույժերի հաշվարկի։
Առաջարկը ներկայացվել էր իր ամբողջական հիմնավորումներով՝ ուղղված բիզնես միջավայրի կանխատեսելիության բարձրացմանը, ավելորդ քրեական ռիսկերից ազատմանը և տնտեսական գործունեության խթանմանը։
Սակայն գործադիրն իր պատասխանում մանրակրկիտ փորձել էր «հիմնավորել», թե փոփոխությունների անհրաժեշտությունը բացակայում է։
Եվ հանկարծ, մեկ տարի անց՝ խորհրդարանական ընտրություններին ընդառաջ, «պարզվում» է, որ պատկերը կտրուկ փոխվել է։
Մարտի 19-ին ՀՀ կառավարության նիստում ընդունվեց որոշում՝ նույն հոդվածը ներկայացնելով նոր խմբագրությամբ։ Ըստ այդմ՝ «խոշոր չափ» է համարվում մեկ հարկային տարվա ընթացքում 30 միլիոն դրամը գերազանցող գումարը (կամ երկու տարվա դեպքում՝ 45 միլիոն), իսկ «առանձնապես խոշոր չափ»՝ մեկ տարվա դեպքում 50 միլիոն դրամը (կամ երկու տարվա դեպքում՝ 75 միլիոն)։
Փաստորեն, այն, ինչ մեկ տարի առաջ որակվում էր որպես «անհրաժեշտություն չունեցող» փոփոխություն, այսօր տեղ է գտնում կառավարության օրակարգում՝ որպես անհրաժեշտ փոփոխություն։
Ի վերջո, պետք է արձանագրել՝ այս փոփոխությունը պետք է վաղուց իրականացվեր՝ բիզնես միջավայրի կայունությունն ու կանխատեսելիությունը ապահովելու համար։ Սակայն այն կյանքի կոչվեց ոչ թե այն պահին, երբ ներկայացվել էին դրա մասնագիտական հիմնավորումները և ընդունման անհրաժեշտությունը, այլ հենց խորհրդարանական ընտրություններին ընդառաջ, և ամենայն հավանականությամբ, պայմանավորված է նախընտրական հաշվարկներով՝ ընտրողների վրա ուղղակի կամ անուղղակի ազդեցություն ունենալու նպատակով։
