ԿԸՀ-ն պարզաբանել է ՝ ովքեր ունեն ընտրելու իրավունք

«Հայաստանի Հանրապետության ընտրական օրենսգիրք» Հայաստանի Հանրապետության սահմանադրական օրենքի (այսուհետ՝ Ընտրական օրենսգիրք) 2-րդ հոդվածի 1-ին մասի համաձայն՝ «Ազգային ժողովի ընտրությունների ժամանակ ընտրելու իրավունք ունեն ընտրության օրը (այսուհետ` քվեարկության օրը) 18 տարին լրացած Հայաստանի Հանրապետության քաղաքացիները։ Այս մասին հայտնում է ԿԸՀ-ն։
«Ընտրական օրենսգրքի 10-րդ հոդվածի 1-ին մասի համաձայն, Հայաստանի Հանրապետության ընտրողների ռեգիստրի հիման վրա կազմվում է համայնքի ընտրողների ցուցակ, ըստ ընտրական տեղամասերի, որում ընդգրկվում են համապատասխան ընտրության ժամանակ ընտրելու իրավունք ունեցող անձինք, որոնք քվեարկության օրվան նախորդող 6 ամսվա ընթացքում ունեցել են անձը հաստատող վավեր փաստաթուղթ: Նշված դրույթի համաձայն՝ ընտրողների ցուցակ ընդգրկվում է միայն ընտրելու իրավունք ունեցող այն անձը, ով քվեարկության օրվան նախորդող 6 ամսվա ընթացքում ունեցել է անձը հաստատող վավեր փաստաթուղթ։
Հարկ է նկատել, որ ընտրելու իրավունք ունեցող այն անձը, ով քվեարկության օրվան նախորդող 6 ամսվա ընթացքում չի ունեցել անձը հաստատող վավեր փաստաթուղթ, չի կորցնում իր ընտրելու իրավունքը և կարող է մասնակցել քվեարկությանը Ընտրական օրենսգրքով սահմանված կարգով։ Այսպես, օրինակ, եթե 18 տարին լրացած ՀՀ քաղաքացին 10 տարի բացակայել է Հայաստանի Հանրապետությունից, այդ ընթացքում նրա անձը հաստատող փաստաթղթի ժամկետը լրացել է, և նա չի դիմել նոր անձը հաստատող փաստաթուղթ ստանալու համար, ապա նրա տվյալները ներառված չեն լինի ընտրողների ցուցակում, եթե նրա անձը հաստատող փաստաթուղթը վավեր չէ քվեարկության օրվան նախորդող 6 ամսվա ընթացքում։ Սակայն, եթե տվյալ քաղաքացին քվեարկության օրը գտնվի Հայաստանի Հանրապետությունում, Հայաստանի Հանրապետության որևէ համայնքում հաշվառում ունենալու դեպքում, նա կարող է դիմել լիազոր մարմին (ՀՀ ՆԳՆ միգրացիայի և քաղաքացիության ծառայություն կամ նրա համապատասխան ստորաբաժանում) կամ դատարան, ստանալ համապատասխանաբար՝ քվեարկության օրը կազմվող ընտրողների լրացուցիչ ցուցակում ընդգրկվելու մասին լիազոր մարմնի տեղեկանք կամ դատական ակտ, այդ փաստաթղթերը ներկայացնելով՝ ընդգրկվել քվեարկության օրը կազմվող ընտրողների լրացուցիչ ցուցակում:
Կարևոր է նշել, որ Հայաստանի Հանրապետությունում հաշվառում չունեցող ընտրողներն Ազգային ժողովի ընտրությունների ժամանակ քվեարկությանը մասնակցելու համար պետք է քվեարկության օրվանից ոչ ուշ, քան 12 օր առաջ՝ մինչև ժամը 14:00-ն, լիազոր մարմին ներկայացնեն դիմում ընտրողների ցուցակում ժամանակավորապես ընդգրկվելու մասին` նշելով քվեարկության օրը Հայաստանի Հանրապետությունում գտնվելու վայրի հասցեն»,- նշված է հաղորդագրությունում:
