ՀՀ քննչական կոմիտեն Հայաստանի արտաքին հետախուզության ծառայության հայտարարության վերաբերյալ նախաձեռնել է քրվարույթ։ Այս մասին կոմիտեն տարածել է հայտարարություն․

«Հայաստանի արտաքին հետախուզության ծառայությունը 2026 թվականի մարտի 10-ին հայտարարություն է տարածել այլ երկրում ՀՀ քաղաքացների նկատմամբ գործադրվող ճնշումների և սպասվող ընտրական գործընթացներին միջամտության վերաբերյալ։

Հայտարարության վերաբերյալ ՀՀ ՆԳՆ-ից ստացված հանցագործության մասին հաղորդման համաձայն՝ օպերատիվ-հետախուզական լիազորությունների իրականացման ընթացքում փաստական տվյալներ են ձեռք բերվել առ այն, որ Հայաստանի Հանրապետության քաղաքական դաշտում գործունեություն ծավալող որոշ կուսակցությունների ղեկավարների, պատասխանատուների կամ այլ դերակատարների կողմից, նյութապես շահագրգռելու եղանակով, խոչընդոտվում է անձանց ընտրական իրավունքի ազատ իրականացումը, այն է՝ այլ երկրի հատուկ ծառայությունների անունից հանդես գալով, տարբեր դերակատարներ, այդ թվում՝ այլ երկրի խոշոր գործարարներ, հայկական համայնքի ղեկավար անձինք, քրեական հեղինակություններ, ճնշում են գործադրում հայազգի և ՀՀ քաղաքացի հանդիսացող ու այլ երկրում տնտեսական գործունեությամբ զբաղվող անձանց նկատմամբ՝ վերջիններիս մղելով Հայաստանում սպասվող խորհրդարանական ընտրություններին մասնակցության հայտ ներկայացրած՝ կուսակցությունների ուժերին աջակցելու գործողություններ իրականացնելուն՝ դրա դիմաց խոստանալով տարբեր պատրվակներով կազմակերպել այլ երկրից ՀՀ տեղափոխելու գործընթացը, փոխհատուցել ճանապարհածախսն ու հոգալ ՀՀ-ում գտնվելու կացության ծախսերը՝ այդ կերպ նյութական կամ այլ կախվածությունն օգտագործելով անձանց հարկադրելով մասնակցել ընտրությանը:

Դեպքի առթիվ ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչության ընդհանուր բնույթի և ընտրական հանցագործությունների քննության վարչությունում նախաձեռնվել է քրեական վարույթ՝ Քրեական օրենսգրքի 210-րդ հոդվածի 2-րդ մասի 3-րդ և 6-րդ կետերի (մի խումբ անձանց կողմից նախնական համաձայնությամբ, նյութապես շահագրգռելով ընտրական կամ հանրաքվեին մասնակցելու իրավունքի իրականացումը, ընտրական հանձնաժողովների աշխատանքներին կամ ընտրությանը կամ հանրաքվեին մասնակցող անձանց իրավունքների կամ պարտականությունների իրականացումը խոչընդոտելը) և նույն հոդվածի 3-րդ մասի 3-րդ կետի (հանրաքվեին կամ ընտրությանը որևէ ձևով քվեարկելուն կամ հանրաքվեին կամ ընտրությանը մասնակցելուն կամ հանրաքվեին կամ ընտրությանը մասնակցելուց հրաժարվելուն կամ մեկից ավելի անգամ կամ այլ անձի փոխարեն քվեարկելուն հարկադրելը, որը կատարվել է նյութական կամ այլ կախվածությունն օգտագործելով) հատկանիշներով:

Ձեռնարկվում են անհրաժեշտ ապացուցողական և վարութային գործողություններ՝ դեպքի ամբողջական հանգամանքները պարզելու, ինչպես նաև քրեական պատասխանատվության անխուսափելիության սկզբունքը կենսագործելու ուղղությամբ:

ՀՀ քննչական կոմիտեն հորդորում է ձեռնպահ մնալ քաղաքացիների ընտրական իրավունքի ազատ կամարտահայտմանը խոչընդոտելուց և զգուշացնում է, որ օրենքով թույլատրված ողջ գործիքակազմի կիրառմամբ ձեռնարկելու է անհրաժեշտ միջոցներ՝ չեզոքացնելու հնարավոր հանցավոր դրսևորումները»։
