Ռուբենը Վարդանյանը որոշել է դատավճիռը չբողոքարկել։
Այս մասին հայտարարություն է տարածել Վարդանյանի ընտանիքը։
«Ռուբեն Վարդանյանի նկատմամբ կայացված դատավճռից հետո տեղեկացնում ենք հետագա իրավական գործողությունների վերաբերյալ նրա դիրքորոշման մասին:
Ռուբենը որոշել է դատավճիռը չբողոքարկել։
Այս որոշումը չի նշանակում համաձայնություն դատավճռի հետ և չի նշանակում հրաժարվում պաշտպանությունից։ Սա գիտակցաբար հրաժարում է լեգիտիմացնելու գործընթացը, որն ի սկզբանե կապ չուներ արդարադատության հետ։
Լսումների ընթացքում կատարվողը ոչ թե դատաքննություն էր, այլ բեմականացում։ Նիստերն անցկացվել են դռնփակ, անկախ դիտորդներին թույլ չի տրվել ներկա գտնվել, միջնորդություններն անտեսվել են։
Դատավճռի ամբողջական տեքստը դատարանի դահլիճում չի հրապարակվել։ Սույն հայտարարության հրապարակման պահին ընտանիքին տրամադրված չի եղել դատավճռի պաշտոնական, գրավոր տեքստը՝ պատշաճ թարգմանությամբ, ինչն ընթացակարգային ևս մեկ կոպիտ խախտում է ու թույլ չի տալիս նույնիսկ ֆորմալ առումով հասկանալ 20 տարվա ազատազրկման հիմքերը։
Բողոքարկումն իմաստ ունի միայն այնտեղ, որտեղ գոյություն ունի առաջին ատյանի դատարանի սխալներն ուղղելու հնարավորություն։ Սակայն երբ խախտումներն ունեն համակարգային բնույթ և առնչվում են արդարադատության հիմնարար սկզբունքներին, բողոքարկումը վերածվում է ապօրինի հետապնդումը լեգիտիմացնող ևս մեկ գործիքի։
Այս պայմաններում վերադաս ատյան դիմելը կնշանակի ճանաչել դատական գործընթացի՝ իրավունքի նորմերի թեկուզ նվազագույն պահանջներին համապատասխանությունը, ինչը բնավ այդպես չէ։
Ռուբենը գիտակցաբար հրաժարվում է դատական գործընթացի իմիտացիային մասնակցելուց։ Նա չի ճանաչում դատավճիռը որպես արդարադատության իրավական ակտ և այն համարում է քաղաքական շարժառիթներով և անօրինական հետապնդման մաս, որը ոչ այլ ինչ է, քան արդարադատության մերժում։
Բողաքարկումից հրաժարումը ոչ թե պայքարի ավարտ է, այլ հրաժարում՝ ֆարսին մասնակցելուց։
Մենք կշարունակենք պայքարել արդարության համար միջազգային իրավական մեխանիզմների և միջազգային այլ ատյանների միջոցով։
Անկարելի է պաշտպանել սեփական իրավունքները մի համակարգում, որն ի սկզբանե մերժում է արդար դատաքննության իրավունքը»։
