Որպես իրավաբան՝ պարտավոր եմ մի քանի բան հստակ ասել Կաթողիկոսի նկատմամբ քրեական հետապնդման մասին. Թաթոյան

Սեղմեք ԱՅՍՏԵՂ, լրացրեք օնլայն հայտը և մոռացեք հոսանքի վարձի մասին 

Որպես իրավաբան՝ պարտավոր եմ մի քանի բան հստակ ասել` կապված Ամենայն Հայոց Կաթողիկոսի նկատմամբ քրեական հետապնդման հետ։ Այս մասին գրել է «Միասնության թեւեր» քաղաքական նախաձեռնության ղեկավար Արման Թաթոյանը։

«Երկրից դուրս գալու [բացակայելու] արգելքը խափանման միջոց է։

Իրավական պետությունում այն պետք է կիրառվի, եթե «դա անհրաժեշտ է մեղադրյալի փախուստը կանխելու համար կամ մեղադրյալի կողմից հանցանք կատարելը կանխելու համար կամ մեղադրյալի կողմից իր վրա Քրեական դատավարության օրենսգրքով կամ դատարանի որոշմամբ դրված պարտականությունների կատարումն ապահովելու համար»։
 
Ես տալիս եմ պարզ մասնագիտական հարց․ ասենք, փախուստի ի՞նչ ռիսկ կա մի մարդու, այն էլ Ամենայն Հայոց Կաթողիկոսի դեպքում, որի տունը Սուրբ Էջմիածինն է։
 
Ո՞ւր է, ըստ Դատախազության կամ Քննչական կոմիտեի, «փախչելու» հազարամյա ինստիտուտի առաջնորդը, որի կյանքն անբաժանելի է այդ պատերից։
 
Եթե Դատախազությունը կամ Քննչական կոմիտեն չի կարող հստակ և համոզիչ պատասխան տալ այս հարցին, նշանակում է՝ քրեական հետապնդումն ու հարկադրանքի միջոցը չունեն իրավական հիմք։ Իսկ իրավական հիմք չունեցող ցանկացած որոշումն այլ անվանում ունի՝ կամայականություն։
Բայց հարցը միայն այս կոնկրետ որոշման մասին չէ։
 
Վարչապետի պաշտոնը զբաղեցնող անձի երեկվա հայտարարությունն ու դրան հաջորդած քրեական հետապնդումը արդարադատություն չեն։
 
Սա Դատախազությունը կամ Քննչական կոմիտեն որպես քաղաքական ճնշման գործիք օգտագործելու հստակ օրինակ է։
 
Երբ իշխանության «մուրճը» հարվածում է Կաթողիկոսարանին և Կաթողիկոսին, դա հանցավորության դեմ պայքար չէ։ Դա փորձ է ենթարկելու իրեն ինստիտուտ, որը նվիրական է, ավելի հին է, քան ցանկացած քաղաքական կուսակցություն և քաղաքական ցանկացած գործիչ։
 
Եկեղեցու ներքին գործերը՝ ձեռնադրությունը, կարգալույծ անելը, եկեղեցական կյանքի կազմակերպումը, Վարչապետի, Դատախազության կամ Քննչական կոմիտեի իրավասության ոլորտը չեն։
 
Եվրոպական ոչ մի պետությունում, որի անդամակցությանը կոչ է անում ներկայիս իշխանությունը, պատմական եկեղեցու առաջնորդը չի ենթարկվում քրեական հետապնդման քաղաքական դրդապատճառներով։
 
Սակայն կա ավելի խորքային հարց․ ինչպե՞ս դարձան օրենսդրության այս կոպտագույն խախտումները հնարավոր մի անձի կողմից, որն ունի Վարչապետի իրավական կարգավիճակ։
 
Պատճառն այն է, որ մեր երկրում հաստատված է անձնիշխանություն և կուսակցապետություն, իսկ այսօրվա Վարչապետը ծառայեցնում է պետական համակարգը նրան ինչ իրեն անձամբ պետք է ու չեն գործում նրան պատասխանատվության ենթարկելու մեխանիզմներ, քանի որ գործող Վարչապետը պետական մարմինները ենթարկեցրել է իրեն անձամբ:
 
Հայաստանին անհրաժեշտ է այնպիսի իշխանություն, որ չի վախենում Եկեղեցուց, և այնքան իմաստուն է, որ Եկեղեցու դեմ պատերազմ չի սկսում։
 
Ներկայիս իշխանությունն իր ապօրինություններով չի հաղթահարել այս փորձություններից (test) որևէ մեկը»։
