«Փաստ» օրաթերթը գրում է.

Պետական գույքի կառավարման կոմիտեն առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2001 թվականի ապրիլի 12-ի N 286-Ն որոշման մեջ։ Հիմք ընդունելով Հողային օրենսգրքի փոփոխությունները՝ նախագծով սահմանվել է, որ համայնքային սեփականություն հանդիսացող հողամասերն օտարվում են բացառապես էլեկտրոնային համակարգի միջոցով՝ կառավարության 2023 թվականի սեպտեմբերի 28-ի N 1667-Ն որոշման համաձայն՝ բացառությամբ Հայաստանի Հանրապետության օրենսդրությամբ նախատեսված սեփականության իրավունքի անհատույց փոխանցման կամ ուղղակի վաճառքի դեպքերի։

Միաժամանակ, նախագծով խմբագրվել են Երևան համայնքում և քաղաքային այլ համայնքներում հողամասերի մրցութային կարգով վարձակալության կամ կառուցապատման իրավունքի տրամադրման էլեկտրոնային սակարկությունների կազմակերպման ու անցկացման առանձնահատկությունները՝ ելնելով նախագծի ընդհանուր տրամաբանությունից, քանի որ պետական և համայնքային սեփականություն հանդիսացող գույքն այսուհետ օտարվելու է միանման ընթացակարգով՝ կառավարության հաստատված կարգով։

Հիմք ընդունելով հողային օրենսգրքի 67րդ հոդվածի 2-րդ մասի դրույթները, ինչպես նաև 2025 թվականի հոկտեմբերի 22-ի ՀՕ344-Ն օրենքով գնահատման գործունեության մասին օրենքում կատարված փոփոխությունները՝ նախագծով սահմանվում է, որ պետական և համայնքային սեփականություն հանդիսացող հողամասերի էլեկտրոնային աճուրդով վաճառքի մեկնարկային գինը հաշվարկվում է՝ հիմք ընդունելով հողամասի գնահատված շուկայական արժեքը, իսկ էլեկտրոնային աճուրդը չկայանալու և չվաճառվելու դեպքում սահմանվել են հաջորդ, երկրորդ, երրորդ և հերթական աճուրդների ժամանակ մեկնարկային գների նվազման չափերը։

Հիմք ընդունելով հողային օրենսգրքի կարգավորումները՝ նախագծով սահմանվել է, որ աճուրդներն անցկացվում են բացառապես էլեկտրոնային եղանակով։

Միաժամանակ, հաշվի է առնվել այն, որ «Ռիելթորական գործունեության մասին» օրենքի, որը ընդունվել է 2025 թվականի նոյեմբերի 13-ին, կարգավորումներով սահմանվել են, որ այս օրենքը չի տարածվում պետական և համայնքային գույքերի նկատմամբ իրականացվող գործարքների վրա։ Դրանով պայմանավորված նախագծով կատարվել են փոփոխություններ, այն է՝ հանվել են ռիելթորների միջոցով էլեկտրոնային սակարկություններով հողամասերի աճուրդները կամ մրցույթներն անցկացնելու վերաբերյալ կարգավորումները։
