Փոփոխություն ու լրացումներ ՀՀ քրեական օրենսգրքում

Սեղմեք ԱՅՍՏԵՂ, լրացրեք օնլայն հայտը և մոռացեք հոսանքի վարձի մասին 

ՀՀ քրեական օրենսգրքի 436-րդ հոդվածը քրեական պատասխանատվություն է նախատեսում կաշառք տալու համար, իսկ նույն հոդվածի 2-րդ եւ 3-րդ մասերում նախատեսված են խոշոր եւ առանձնապես խոշոր չափերով կաշառք տալու հանցակազմերը: ՀՀ արդարադատության նախարարի տեղակալ Գեւորգ Քոչարյանի խոսքով վերոնշյալ հոդվածով նախատեսված կաշառք տալու հանցակազմի առարկա կաշառքի չափերի հստակեցման կապակցությամբ առկա է օրենսդրական բաց, որն էլ շտկելու նպատակով Կառավարությունը հանդես է եկել օրենսդրական առաջարկով: Այս մասին տեղեկացնում են ԱԺ մամուլի ծառայությունից:

Ըստ այդմ՝ առաջարկվում է ՀՀ քրեական օրենսգրքի 3-րդ հոդվածի 17-րդ կետում լրացում կատարել. այն է՝ «հանցավոր ճանապարհով ձեռք բերված» բառերից հետո լրացնել «տրված» բառը, որն իրենից ենթադրում է խոստանալ, առաջարկել կամ տրամադրել: Այլ կերպ՝ Քրեական օրենսգրքի 3-րդ հոդվածի 17-րդ կետում խնդրո առարկա հանցանքների օբյեկտիվ կողմը կազմող հիշյալ գործողությունների առանձին թվարկման անհրաժեշտությունը բացակայում է: Հանցագործությունն ավարտված է համարվում կաշառքը կամ ապօրինի վարձատրությունը տալու, առաջարկելու, խոստանալու կամ տրամադրելու պահից:

Հաջորդ փոփոխությամբ առաջարկվում է ՀՀ քրեական օրենսգրքի 83-րդ հոդվածի 7-րդ մասն ուժը կորցրած ճանաչել: Եվ երրորդ՝ վերջին փոփոխությամբ առաջարկվում է ՀՀ քրեական օրենսգրքի 87-րդ հոդվածի 6-րդ եւ 7-րդ մասերում հղում կատարել նաեւ անչափահասներին վաղեմության ժամկետն անցնելու հետեւանքով քրեական պատասխանատվությունից ազատելու իրավանորմին:

Փոխնախարարի խոսքով օրենսդրական բացը լրացնելու անհրաժեշտությունն առաջացել է Վճռաբեկ դատարանի նախադեպային որոշումից:

Օրենքի նախագիծը քննարկվել եւ դրական եզրակացություն է ստացել ՀՀ ԱԺ պետական-իրավական հարցերի մշտական հանձնաժողովի՝ փետրվարի 5-ին հրավիրած նիստում:
