Ինչո՞ւ է ՍԴ-ն խուսափում հարցին պատասխանել՝ անտեսելով օրենսդրական պահանջը. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Ոչ մեկ անգամ առիթ ունեցել ենք նշելու, որ Հայաստանի օրվա իշխանությունները օգտագործում են ամեն հնարավորություն՝ օրենքների տարբեր վիճահարույց դրույթները որպես մահակ կիրառելու ընդդիմության դեմ: Դրանցից մեկը վերաբերում է ՀՀ Քրեական օրենսգրքի չարաբաստիկ 236 հոդվածի 2րդ մասին, որը քրեական պատասխանատվություն է ենթադրում հանրահավաքին մասնակցելու կամ հավաքին մասնակցելուց հրաժարվելու նպատակով նյութապես շահագրգռելու համար:
Հիշեցնենք, որ դեռևս 2024 թվականին ԱԺ պատգամավորների 1/5ը դիմել էր Սահմանադրական դատարան՝ այդ կետը հակասահմանադրական ճանաչելու համար: ՍԴն հայցը վարույթ էր ընդունել, սակայն հետո ՍԴԱՈ156 որոշմամբ կասեցրել էր վարույթն ու խորհրդատվական կարծիքի համար դիմել Վենետիկի հանձնաժողով: Մեկ տարի անց ստացվել էր Հանձնաժողովի կարծիքը, այն է՝ այդ նորմը հակասում է իրավական որոշակիության սկզբունքին, ինչպես նաև ազատ հավաքներ անցկացնելու ԵՄ ուղեցույցին: Տրամաբանորեն դրանից հետո ՍԴն պետք է վերսկսեր հարցի քննությունը, սակայն դա չի անում:
Մենք դեռևս 2025 թ. դեկտեմբերի 15ին գրավոր հարցում էինք ուղարկել ՍԴ՝ խնդրելով պատասխանել, թե ե՞րբ է նախատեսվում վերսկսել հարցի քննությունը: ՍԴն հինգ աշխատանքային օրվա ընթացքում պետք է որևէ գրություն ուղարկեր՝ կա՛մ հարցին որևէ կերպ պատասխանելու, կա՛մ «լրացուցիչ ուսումնասիրության» համար ևս 30 օրվա անհրաժեշտության մասին ծանուցելու (թեպետ դժվար է պատկերացնել, թե այդ պարզ հարցին պատասխանելու համար ինչ «լրացուցիչ ուսումնասիրություն» կարող է պետք լինել): Անցել է 17 աշխատանքային օր, սակայն ՍԴից այդպես էլ պատասխան չենք ստացել: Բարձրագույն դատարանն ինքն այսպիսով անտեսում է օրենսդրական պահանջը: Դժվար է ասել՝ իրենք էլ չեն կողմնորոշվե՞լ՝ ինչ պետք է անեն, թե՞ չեն պատկերացնում՝ ինչպես չնեղացնել Նիկոլ Փաշինյանին, բայց և ակնհայտ հակաօրինական գործողությունների չգնալ: Ավելին, ՍԴ կայքում տեղադրված է ՍԴ առաջիկա նիստերի ժամանակացույցը, որտեղ առնվազն մինչև մարտի 3ը այդ հարցի քննարկում նախատեսված չէ:
Հիշեցնենք, որ նախորդ հրապարակման մեջ տեղեկացրել էինք, որ, մեր ունեցած տեղեկություններով, հասկանալով, որ այլ որոշում, քան հակասահմանադրական ճանաչելն է, հնարավոր չէ ընդունել, ՍԴ նախագահին դիմել է հենց Նիկոլ Փաշինյանը, որպեսզի հարցի քննությունը առնվազն մինչև առաջիկա ընտրություններ ձգձգվի:
