Վաղարշապատ համայնքում անցկացված ավագանու ընտրություններից շուրջ մեկուկես ամիս անց «Հայրենիք» կուսակցության անդամների, այդ թվում՝ գլխավոր քարտուղար Խաչիկ Գալստյանի ձերբակալությունները դժվար է դիտարկել իրավական հարթության վրա։ Այս մասին գրել է քաղաքագետ Սուրեն Սուրենյանցը:

«Նման ժամանակագրությունը ինքնին լուրջ հարցեր է առաջացնում և տեղի ունեցածին հաղորդում է ակնհայտ քաղաքական ենթատեքստ։

Ընտրական իրավախախտումները, հատկապես ընտրակաշառքի հետ առնչվող դեպքերը, իրավական պրակտիկայում, որպես կանոն, բացահայտվում և քննվում են ընտրական գործընթացի ընթացքում կամ անմիջապես դրա ավարտից հետո։

Երբ քրեական հետապնդումը մեկնարկում է զգալի ժամանակ անց՝ առանց հանրությանը ներկայացվող նոր, հստակ և փաստարկված ապացույցների, այն անխուսափելիորեն ընկալվում է որպես ընտրովի արդարադատության դրսևորում։

Ավելին, ընտրակաշառքը Հայաստանի քաղաքական համակարգում երբեք մեկ համայնքով կամ մեկ քաղաքական ուժով սահմանափակված երևույթ չի եղել։

Եթե Վաղարշապատում արձանագրված ենթադրյալ խախտումները դարձել են կալանավորումների հիմք, ապա օրինաչափ հարց է ծագում՝ ինչո՞ւ նույն խստությամբ և հետևողականությամբ իրավապահ մարմինները չեն արձագանքում այլ համայնքներում արձանագրվող նմանատիպ դեպքերին, երբ դրանց հեղինակն իշխանությունն է։

Վաղարշապատի ընտրությունների ժամանակ և նախընտրական շրջանում եղել են բազմաթիվ ահազանգեր խախտումների մասին նաև իշխող «Քաղաքացիական պայմանագիր» կուսակցության կողմից (օրինակ՝ վարչական ռեսուրսների չարաշահում, բարեգործության քողի տակ քարոզչություն), բայց դրանց նկատմամբ նման խստություն չի դրսևորվել, իրավական գործընթաց չի հարուցվել:

Հենց այս անհամաչափությունն է, որ լրջորեն խաթարում է մեղադրանքների արժանահավատությունն ու իրավական ընկալումը։

Այս համատեքստում իրականացված ձերբակալությունները ոչ թե իրավական քայլեր են, այլ իշխանության համակարգված քաղաքականության արտահայտություն՝ քաղաքական դաշտը «ֆիլտրելու», ընդդիմադիր ուժերին ճնշելու և ընտրություններից առաջ կառավարելի քաղաքական միջավայր ապահովելու նպատակով։

Իրավապահ համակարգը, փոխանակ հանդես գալու որպես անկախ և չեզոք ինստիտուտ, գործարկվում է որպես քաղաքական գործընթացների վրա ազդելու մեխանիզմ։

Վերջապես, խնդիրը սահմանափակված չէ տվյալ քրեական գործով։

Այն ունի համակարգային բնույթ և վերաբերում է հանրային վստահության խոր ճգնաժամին, որտեղ արդարադատությունը այլևս չի ընկալվում որպես ժամանակին, անաչառ և կանխատեսելի ինստիտուտ, այլ՝ որպես իշխանության կողմից կիրառվող գործիք՝ իշխանությունների քաղաքական նպատակահարմարությունից բխող ժամանակացույցով։

Իմ քաղաքական զորակցությունն եմ հայտնում Խաչիկ Գալստյանին և «Հայրենիք» կուսակցության մյուս անդամներին՝ համոզված լինելով, որ տեղի ունեցողը ոչ թե իրավական արդարադատության, այլ քաղաքական ճնշման դրսևորում է։

Նման մեթոդներով քաղաքական դաշտը «մաքրելը» չի կարող ապահովել ոչ ժողովրդավարություն, ոչ վստահություն, ոչ էլ իրական կայունություն»,-գրել է նա:
