ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչության կիբեռհանցագործությունների և բարձր տեխնոլոգիաների ոլորտում կատարված հանցագործությունների վարչությունում նախաձեռնված քրեական վարույթի նախաքննության ընթացքում առերևույթ փաստական տվյալներ են ձեռք բերվել անձի կողմից համակարգչային խարդախություն և փողերի լվացում կատարելու վերաբերյալ:
Մասնավորապես՝ Մ.Ա.-ն 2021 թվականի հունիսի 24-ից մինչև 2022 թվականի նոյեմբերի 15-ն ընկած ժամանակահատվածում հանցավոր ճանապարհով ֆինանսական միջոցներ ձեռք բերելու նպատակով ապօրինի հասանելիություն է ստացել տարբեր կայքերում գրանցված խաղային և վճարահաշվարկային կազմակերպությունում գրանցված հաշվառման հաշիվներին և համակարգչային տվյալը մուտքագրելու միջոցով հափշտակել է անձանց խաղային հաշիվներին և կցված բանկային քարտերին առկա ընդհանուր՝ 3 մլն 398.350 ՀՀ դրամ գումարը:
Այնուհետև, Մ.Ա.-ն հափշտակված գումարը ելքագրումների կամ խաղային պարտությունների տեսքով փոխանցել է տարբեր կայքերում այլ անձանց անվամբ գրանցված և իր կողմից փաստացի կառավարվող խաղային, էլեկտրոնային դրամապանակների հաշիվներին՝ ստանալով դրանք տնօրինելու հնարավորություն:
Բացի այդ, Մ.Ա.-ն հանցավոր ճանապարհով ձեռք բերված գումարների ծագման աղբյուրը և իրական բնույթը թաքցնելու նպատակով՝ մշակված հանցավոր գործողությունների կիրառմամբ մի շարք անձանց՝ իր կողմից կառավարվող հաշիվներից մյուս հաշիվներին փոխանցելու, նոր հաշվում առաջացած գումարը որպես խաղադրույքի արդյունքում առաջացող հաղթանակ ցուցադրելով, խաղադրույքներով և կանխիկացումներով կատարել է փողերի լվացում:
Մ.Ա.-ի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ Քրեական օրենսգրքի 257-րդ հոդվածի 2-րդ մասի 3-րդ կետով (խոշոր չափերով համակարգչային հափշտակությունը) և 296-րդ հոդվածի 1-ին մասով (փողերի լվացումը):
Քրեական վարույթը մեղադրական եզրակացությամբ ուղարկվել է հսկող դատախազին՝ այն հաստատելու և ըստ էության քննության առնելու համար դատարան ուղարկելու միջնորդությամբ:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով։
