«Կատարողական վարույթի մասին» օրենքն ընդունվել է 2024 թվականին եւ ուժի մեջ պետք է մտնի հունվարի 1-ից: ՀՀ արդարադատության նախարարի տեղակալ Տիգրան Դադունցի խոսքով օրենքի որոշ կարգավորումներ ուժի մեջ են մտնելու մարտի 1-ից: Խոսքը վերաբերում է դատարանների հետ կապուղիների, էլեկտրոնային եղանակով հարկադիր կատարման դիմումների ներկայացման հետ կապված կարգավորումներին:
«Այս կարգավորումներից ենթադրվում էր, որ կատարողական թերթի ինստիտուտը պետք է վերանար, եւ պարտատերն անձամբ պետք է էլեկտրոնային եղանակով դիմի Հարկադիր կատարումն ապահովող ծառայություն: Վերջինս էլ դատարանից պետք է ստանա դատական ակտի եզրափակիչ մասի տվյալները եւ հարուցի կատարողական վարույթ»,- ընդգծել է Տիգրան Դադունցը: Ըստ զեկուցողի՝ քանի որ թվայնացման հետ կապված հարցերում առաջացել են որոշակի օբյեկտիվ խոչընդոտներ, պարզ է դարձել, որ մարտի 1-ից այդ կարգավորումների լիարժեք համակցումը հնարավոր չի լինի իրականացնել: Քաղաքացիների իրավունքների պաշտպանության նպատակով Կառավարությունն առաջարկում է երկարաձգել էլեկտրոնային եղանակով հարկադիր կատարման դիմում ներկայացնելու համակարգի ներդրման ժամկետը մինչեւ 2026 թվականի սեպտեմբերի 1-ը:
Հաջորդ կարգավորմամբ առաջարկվել էր կատարողական ծախսերի բռնագանձման նոր կանոնները նաեւ տարածել նախկինում հարուցված գործերի վրա: Կառավարության ներկայացուցչի տեղեկացմամբ վերլուծության արդյունքում պարզվել է, որ դա հանգեցնելու է կատարողական ծախսերի վերահաշվարկների եւ տարբերակմանը, որը մեծաթիվ վարույթների դեպքում օբյեկտիվորեն հնարավոր չէ: Նշվել է, որ ծառայությունը տարեկան ընթացք է տալիս շուրջ 2 մլն կատարողական վարույթի: Նախառեձնությամբ առաջարկվում է նոր կարգավորումները տարածել նոր վարույթների վրա՝ զրոյից:
Հարակից զեկուցող, Պետական-իրավական հարցերի մշտական հանձնաժողովի անդամ Ալխաս Ղազարյանը, կարեւորելով նախաձեռնությունը, կոչ է արել կողմ քվեարկել:
«Կատարողական վարույթի մասին» օրենքում եւ կից ներկայացված օրենքներում փոփոխություններ նախատեսող օրենդրական փաթեթը քննարկվել է ԱԺ պետական-իրավական հարցերի մշտական հանձնաժողովի՝ դեկտեմբերի 15-ի արտահերթ նիստում եւ ստացել դրական եզրակացություն:
