Մինչև 300,000 դրամ տուգանքները պետական մարմիններն այլևս չեն կարող բողոքարկել․ Սրբուհի Գալյան

Կառավարությունը հաստատել և Ազգային ժողով է ուղարկել Վարչական դատավարության օրենսգրքում փոփոխություններ կատարելու վերաբերյալ օրենսդրական փաթեթը, որը ևս մեկ քայլ է ուղղված դատարանների ծանրաբեռնվածության թոթափմանը և արդյունավետ դատավարությունների կազմակերպմանը։ Տեղեկանում ենք արդարադատության նախարար Սրբուհի Գալյանի ֆեյսբուքյան էջից։
«Փաթեթով նախատեսվում է, որ վերաքննության կարգով ներկայացված բողոքները վարչական դատարանում պետք է քննվեն գրավոր ընթացակարգով, և միայն պատճառաբանված որոշման պարագայում պետք է տեղի ունենա գործի բանավոր քննություն։
Նախատեսվում է նաև, որ վերաքննության կարգով ներկայացված բողոքները պետք է ունենան քննության հստակ ժամկետ, այն է՝ 6 ամիսը, որը կարող է երկարաձգվել միայն մեկ անգամ՝ 4 ամիս ժամկետով։
Սիրելի՛ քաղաքացիներ, հստակ գիտակցելով, որ ունենք մի շարք խնդիրներ կապված պետական մարմինների և տեղական ինքնակառավարման մարմինների կողմից իրականացվող վարչարարության որակի հետ, նախատեսել ենք վարչական մարմինների՝ վերաքննիչ բողոք ներկայացնելու իրավունքի սահմանափակում՝ մինչև 300,000 ՀՀ դրամ տուգանք պարունակող վարչական ակտերի պարագայում։ Այսինքն՝ պետական և տեղական ինքնակառավարման մարմիններն այլևս հնարավորություն չեն ունենա ներկայացնել վերաքննիչ բողոք այն դեպքում, երբ իրենց կողմից կայացված վարչական ակտով սահմանված տուգանքի գինը չի գերազանցում 300,000 ՀՀ դրամը։
Այս փոփոխությունը մի կողմից, ինչպես արդեն նշեցի, կնպաստի դատարանների ծանրաբեռնվածության թոթափմանը և քաղաքացիների համար մատչելի արդարադատության իրականացման իրավունքի ապահովմանը, իսկ մյուս կողմից՝ կհրավիրի վարչարարություն իրականացնող մարմինների ուշադրությունը պատշաճ վարչարարության իրականացման վրա՝ ավելացնելով նրանց զգոնության աստիճանը»,-նշել է նա։
