Դատարանը պարտավորեցրել է Johnson & Johnson-ին 40 մլն դոլար վճարել մանկական ցանափոշու պատճառով քաղցկեղ ձեռք բերած կանանց

Կալիֆոռնիայի դատարանի ատենակալներն ուրբաթ որոշել են 40 մլն դոլար հատկացնել երկու կանանց, որոնք հայտարարել են, որ Johnson & Johnson ընկերության մանկական ցանափոշին դարձել է իրենց մոտ ձվարանների քաղցկեղի առաջացման պատճառ, գրել է The Guardian-ը։
Լոս Անջելեսի Գերագույն դատարանին կից դատարանը որոշել է Մոնիկա Քենթին վճարել տալ 18 միլիոն եւ Դեբորա Շուլցին ու նրա ամուսնուն՝ 22 միլիոն դոլար, գալով այն եզրակացության, որ Johnson & Johnson-ը տարիներ շարունակ իմացել է իր՝ տալկի վրա հիմնված արտադրանքի վտանգների մասին, բայց չի զգուշացրել սպառողներին։
Johnson & Johnson-ի դատական գործերով փոխնախագահ Էրիկ Հաասը նշել է, որ ընկերությունը մտադիր է «անհապաղ բողոքարկել այս դատավճիռը եւ ակնկալում է հաղթել, ինչպես լինում է նման անոմալ որոշումների դեպքում»։
Դատական փաստաթղթերի համաձայն՝ Մոնիկա Քենթի մոտ ձվարանների քաղցկեղ է ախտորոշվել 2014թ․, իսկ Դեբորա Շուլցի մոտ՝ 2018թ․։ Երկու կանայք էլ ապրում են Կալիֆոռնիայում եւ պնդում են, որ մոտ 40 տարի լոգանք ընդունելուց հետո օգտագործել են Johnson & Johnson մանկական փոշի։ Դատավարության ընթացքում նրանք նկարագրել են իրենց բուժումը, որը ներառել է ծանր վիրահատություններ եւ քիմիաթերապիայի տասնյակ փուլեր։
Եզրափակիչ խոսքում հայցվորների փաստաբան Էնդի Բյորչֆիլդը ատենակալներին ասել է, որ Johnson & Johnson-ը 1960-ական թթթ. ի վեր տեղյակ է եղել իր արտադրանքի քաղցկեղածին ռիսկերի մասին: Նա պնդել է, որ ընկերությունը «դիտավորյալ թաքցրել է վտանգների մասին ճշմարտությունը»:
Իր հերթին, Johnson & Johnson-ի փաստաբան Էլիսոն Բրաունը նշել է, որ միակ մարդիկ, ովքեր պնդում էին, որ Քենթի եւ Շուլցի քաղցկեղն առաջացել է տալկից, նրանց իրավաբաններն էին: Նա ընդգծել է, որ ենթադրյալ կապը չի հաստատվել ԱՄՆ որեւէ խոշոր առողջապահական մարմնի կողմից, եւ չկան ուսումնասիրություններ, որոնք ապացուցում են, որ տալկը կարող է մարմնի մակերեսից տեղափոխվել վերարտադրողական օրգաններ:
Դատարանի նյութերի համաձայն՝ Johnson & Johnson-ը բախվում է ավելի քան 67 հազար դատական հայցի՝ տրված այն մարդկանց կողմից, որոնք հայտնել են, որ քաղցկեղ ունեն մանկական ցանափոշի եւ տալկ պարունակող այլ արտադրանք օգտագործելուց հետո: Johnson & Johnson-ը պնդել է, որ իր արտադրանքը անվտանգ է, ասբեստ չի պարունակում եւ քաղցկեղ չի առաջացնում: 2020թ․ ընկերությունը դադարեցրել է տալկի փոշու վաճառքը Միացյալ Նահանգներում՝ այն փոխարինելով եգիպտացորենի օսլայի վրա հիմնված արտադրանքով:
