Օրենքի վիճահարույց դրույթը՝ քաղաքական մահակ. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Հայաստանի օրվա իշխանությունները օգտագործում են ամեն հնարավորություն՝ դրանք որպես մահակ կիրառելու ընդդիմության դեմ: Դրանցից մեկը վերաբերում է ՀՀ Քրեական օրենսգրքի չարաբաստիկ 236 հոդվածի 2-րդ կետի 2-րդ մասին, որը քրեական պատասխանատվություն է ենթադրում հանրահավաքին մասնակցելու կամ հավաքին մասնակցելուց հրաժարվելու նպատակով նյութապես շահագրգռելու համար:
Հիշեցնենք, որ դեռև 2024 թվականի ԱԺ պատգամավորների 1/5-ը դիմել էր Սահմանադրական դատարան՝ այդ կետը հակասահմանադրական ճանաչելու համար: Սդ-ն հայցը վարույթ էր ընդունել, սակայն հետո կասեցրել էր վարույթն ու խորհրդատվական կարծիքի համար դիմել Վենետիկի հանձնաժողով: Մեկ տարի անց ստացվել է Հանձնաժողովի կարծիքը, այն է՝ հավաքին մասնակցելու (հավաքին մասնակցելուց հրաժարվելու) նպատակով նյութապես շահագրգռելու համար քրեական պատասխանատվություն նախատեսող նորմը հակասում է իրավական որոշակիության սկզբունքին, ինչպես նաև ազատ հավաքներ անցկացնելու ԵՄ ուղեցույցին:
Տրամաբանորեն դրանից հետո ՍԴ-ն պետք է վերսկսեր հարցի քննությունը, սակայն դա չի անում: Մեր ունեցած տեղեկություններով, հասկանալով, որ այլ որոշում, քան հակասահմանադրական ճանաչելն է, հնարավոր չէ ընդունել, ՍԴ նախագահին դիմել է հենց Նիկոլ Փաշինյանը, որպեսզի հարցի քննությունը առնվազն մինչև առաջիկա ընտրություններ ձգձգվի: Դա հնարավորություն կտա իշխանություններին՝ վիճահարույց այդ նորմը որպես մահակ կիրառել ընդդիմադիրների նկատմամբ, ինչպես արվել է մինչ այս: Հիշեցնենք, որ այդ հոդվածով «գործ» է կարվել բազմաթիվ ընդդիմադիրների, այդ թվում՝ «ՀայաՔվե» ազգային քաղաքացիական միավորման համակարգող Ավետիք Չալաբյանի, ՀՅԴ Հայաստանի ԳՄ անդամ Գերասիմ Վարդանյանի և այլոց նկատմամբ:
