Հայաստանում քաղաքական պատվերի արդյունքում կիրառվում է միայն կալանքը: Հետևաբար կալանքը չի հանդիսանում քրեական դատավարության օրենսգրքով սահմանված խափանման միջոց, այլ որոշվում է իրավունքից դուրս ըստ քաղաքական նպատակի:  Այս մասին Facebook–ի իր էջում գրել է փաստաբան Արամ Վարդևանյանը։

«Հայաստանում կան քաղբանտարկյալներ, Հայաստանում բառիս ուղիղ իմաստով խնդիր է դրվել՝ քրեակատարողական հիմնարկները մարդկանցով լցնել: Պատկերացրեք հինգ ամսից ավելի է բանտում է գտնվում Սամվել Կարապետյանը և 53 քննիչներ, բազմաթիվ դատախազներ և մի շարք դատավորներ անտեսելով իրավունքն ու օրենքը հենց միայն կալանք են պահանջում ու ընտրում որպես խափանման միջոց: Իրապես այս գործում չկա ոչ մի տվյալ, ոչ մի հիմք՝ գործ չկա, բայց կա հինգ ամսից ավելի տևող ապօրինի կալանք:

Ի դեպ այն իբր նպատակը և այն իբր խնդիրները որոնք կարող են լուծվել կալանքով, ամբողջությամբ կարող են լուծվել այլ խափանման միջոցներով, բայց այլևս փաստ է, այլևս տևական հաստատված փաստ է, որ Հայաստանում քաղաքական պատվերի արդյունքում կիրառվում է միայն կալանքը: Հետևաբար կալանքը չի հանդիսանում քրեական դատավարության օրենսգրքով սահմանված խափանման միջոց, այլ որոշվում է իրավունքից դուրս ըստ քաղաքական նպատակի:

Մեր հասարակությունը մինչ օրս շոկի մեջ է, թե ոնց կարող են ոչ թե պարզապես կալանավորված, այլ տևական ժամանակով կալանավորված լինել Ազգային բարերար, Սրբազաններ, ԱԺ պատգամավոր՝ Արթուր Սարգսյանը, այլ անձինք և Հայաստանում հինգ ամիս է կա կին քաղբանտարկյալ Լիդյա Մանթաշյանը: Հայաստանում թեկուզ ցնցող, կամ տհաճ խոսքի համար կրկին հենց կալանավորված են Նարեկն ու Վազգենը: Այսինքն ողջամիտ հարց է առաջանում արդյոք այլ խափանման միջոցներ Հայաստանում չկան: Պատասխանն ակնհայտ է, իհարկե կան այլ խափանման միջոցներ, սակայն քաղաքական հետապնդումը չի ընդունում այլ խափանման միջոցներ և Դատարանները չեն կարող նման դեպքերով իրենց թույլ տալ կիրառել այլ խափանման միջոց: Այդ իսկ պատճառով որևէ մի պահ պետք է չհուսահատվել, չկասկածել, որ իրավունքը նույնիսկ այս աբսուրդի, այս բռնատիրական մոտեցումների՝ պետք է գերակայող լինի:
