2025 թվականի հոկտեմբերի 16-ին Հակակոռուպցիոն դատարանը երկարաձգել էր Սամվել Կարապետյանի կալանքը մեկ ամսով, հերթական անգամ արձանագրելով տնտեսական բնույթի մեղադրանքերում հիմնավոր կասկածի բացակայությունը:
Դատարանի որոշման դեմ բողոքներ էինք ներկայացրել և մենք, և Դատախազությունը: Մենք ակնկալում էինք, որ կալանքը վերացվեր անհապաղ և արձանագրվեր նաև <<կոչի>> դրվագով հիմնավոր կասկածի բացակայությունը: Դատախազությունը պահանջում էր, որ արձանագրվեր տնտեսական բնույթի մեղադրանքներով հիմնավոր կասկածը և փաստացի մեկ ամիս կալանքի փոխարեն՝ 2 ամիսը: Վերաքննիչ դատարանն անփոփոխ է թողել Հակակոռուպցիոն դատարանի որոշումը:
Դատարանի որոշման դեմ բողոքներ էինք ներկայացրել և մենք, և Դատախազությունը: Մենք ակնկալում էինք, որ կալանքը վերացվեր անհապաղ և արձանագրվեր նաև <<կոչի>> դրվագով հիմնավոր կասկածի բացակայությունը: Դատախազությունը պահանջում էր, որ արձանագրվեր տնտեսական բնույթի մեղադրանքներով հիմնավոր կասկածը և փաստացի մեկ ամիս կալանքի փոխարեն՝ 2 ամիսը: Վերաքննիչ դատարանն անփոփոխ է թողել Հակակոռուպցիոն դատարանի որոշումը:
Հիշեցման կարգով 1՝ Հակակոռուպցիոն դատարանը դեռևս հոկտեմբերի 16-ին պահանջել էր քննչականից, որ <<կոչի>> դրվագով, կամ գործն ուղարկեն Դատարան կամ կարճեն: Քննչական մարմինը բաղկացած 53 քննիչներից հերթական անգամ արձանագրել է վճռական անգործությունը և անհարգալից վերաբերմունքը դատական ակտի նկատմամբ:
Հիշեցման կարգով 2՝ Վճռաբեկ դատարանը հոկտեմբերի 24-ին վարույթ է ընդունել Դատախազության անհիմն բողոքը և ակնհայտ է, որ քաղաքական հետապնդման պայմաններում ակնկալվում է ռեկորդային արագությամբ դատական ակտ: Իմ կանխատեսումն այն էր, որ Վճռաբեկ դատարանը ընդհանրապես չի իրականացնելու արդարադատություն, քանի որ բողոքում գրված է Սամվել Կարապետյան անուն ազգանունը և բողոք բերողը Դատախազությունն է: Ի դեպ մանրամասն ուսումնասիրել եմ Վճռաբեկ դատարանի հակակոռուպցիոն պալատի կողմից վարույթ ընդունելու և որոշումներ կայացնելու տևողության պրակտիկան, դեռևս որևէ դեպք չի եղել, որ նույնիսկ մեկ ամսվա ընթացքում Վճռաբեկ դատարանի կողմից որոշում կայացվի:
Հիշեցման կարգով 3՝ Սամվել Կարապետյանը շուրջ հինգ ամիս է ինչ ակնհայտ ապօրինի կալանավորված է բացառապես Մայր Աթոռը պաշտպանող խոսքի համար:
