ՀՀ վարչապետ Նիկոլ Փաշինյանի ավտոշարասյան կողմից վրաերթի ենթարկված Սոնա Մնացականյանի և նրա չծնված երեխայի մահվան գործով մեղադրյալ Արամ Նավասարդյանը շարունակում է ազատության մեջ լինել, դատավճիռն էլ մինչ օրս չի ուղարկվել կողմերին։
Sputnik Արմենիայի հետ զրույցում այս մասին ասաց տուժողի պաշտպան Րաֆֆի Ասլանյանը։
Նա բացատրեց՝ Արամ Նավասարդյանը կարող է արգելանքի վերցվել միայն այն դեպքում, երբ դատավճիռն օրինական ուժի մեջ մտնի, իսկ այս դատավճիռը դեռևս կատարման ենթակա չէ։
Թեպետ օգոստոսի 18-ին դատարանը որոշեց Արամ Նավասարդյանին ազատազրկել 1 տարի 6 ամիս ժամկետով, սակայն չփոխեց նրա խափանման միջոց բացակայելու արգելքը, մինչև դատավճռի օրինական ուժի մեջ մտնելը։
«Դատավճիռը դեռևս կողմերին չի ուղարկվել այս պահի դրությամբ, կողմերին ուղարկվելուց հետո այն բնականաբար բողոքարկվելու է և դատական վերանայման առարկա է դառնալու։ Եթե բոլոր դատական ատյաններում, այսինքն՝ հետագայում վերաքննիչ և վճռաբեկ դատարաններում դատավճիռը մնա անփոփոխ, նոր միայն օրինական ուժի մեջ է մտնելու, և այդ ժամանակ պատժի կրման, դատավճռի կատարման հարց է բարձրացվելու։ Քանի դեռ դատավճիռն օրինական ուժի մեջ չի մտել, վաղեմության ժամկետի ընթացքը դեռ հոսում է»,- բացատրեց Ասլանյանը։
Նրա խոսքով՝ եթե գործընթացը շարունակվի ձգձգվել և դատավճիռն օրինական ուժի մեջ չմտնի մինչև 2027թ․ ապրիլի վերջ, այսինքն՝ Սոնա Մնացականյանի մահվան 5-րդ տարելիցը, կստացվի, որ Արամ Նավասարդյանն էլ կազատվի պատժից վաղեմության ժամկետն անցնելու հիմքով։ Ինչու՞ դատավոր Կարեն Ֆարխոյանը մինչ օրս չի ուղարկել դատավճիռը կողմերին․ կոնկրետ այս հարցում փաստաբանը դիտավորություն չի կարող տեսնել, որովհետև դատարանները ծանրաբեռնված են, և դատավճիռներ կան, որոնք 3-6 ամիս հետո են ուղարկվում կողմերին։ Սակայն Ասլանյանն ընդգծում է՝ արդեն 4 տարի է՝ ասում է, որ իշխանության միջամտությամբ գործը ձգձգվում է։
