Փարիզի դատարանը երկուշաբթի օրը որոշում կկայացնի Ֆրանսիայի նախկին նախագահ Նիկոլա Սարկոզիին ազատելու վերաբերյալ՝ ընդամենը 20 օր անց այն պահից, երբ նա բանտարկվել է, գրում է Associated Press-ը։
Նա դատապարտվել է հինգ տարվա ազատազրկման՝ 2007 թվականի հաղթական նախընտրական քարոզարշավը Լիբիայից ստացված միջոցներով ֆինանսավորելու նպատակով հանցավոր դավադրության մեղադրանքով։
70-ամյա Սարկոզին ժամանակակից Ֆրանսիայի առաջին նախկին նախագահն է, որը դատապարտվել է իրական ազատազրկման։ Նախկինում նա դատապարտվել էր կոռուպցիայի մեղադրանքով, սակայն նրան պարտադրվել էր կրել էլեկտրոնային ապարանջան՝ ազատազրկումից խուսափելու համար։
Սարկոզիի փաստաբանները բողոքարկել են դատավճիռը և ներկայացրել են վաղաժամ ազատման միջնորդություն։ Վերաքննիչ գործընթացը նախատեսվում է ավելի ուշ՝ հնարավոր է գարնանը։
Երկուշաբթի օրը Փարիզի դատարանը կքննարկի նրա ազատման միջնորդությունը, և որոշումը սպասվում է նույն օրը։ Նախկին նախագահը, որը պաշտոնավարել է 2007-ից 2012 թվականներին, պնդում է, որ անմեղ է և վիճարկում է ինչպես մեղադրական դատավճիռը, այնպես էլ կալանքի որոշումը՝ մինչև վերաքննիչ գործընթացը։
Սարկոզին կարող է ազատվել՝ ըստ Ֆրանսիայի քրեական օրենսգրքի 144-րդ հոդվածի, որը սահմանում է, որ մինչև վերաքննիչ բողոքի ներկայացումը ազատումը պետք է լինի ընդհանուր կանոն, իսկ կալանքը՝ բացառություն՝ կիրառելի միայն այն դեպքերում, երբ անձը համարվում է վտանգավոր, կարող է փախչել երկրից, կամ կա անհրաժեշտություն պաշտպանել ապացույցները կամ կանխել ճնշումը վկաների վրա։ Սա կապ չունի դատավճռի պատճառաբանության հետ։
Սպասվում է, որ երկուշաբթի օրը կայանալիք լսումների ընթացքում Սարկոզին կներկայացնի երաշխիքներ, որ կկատարի պայմանական ազատման պահանջները։ Դրանց ընդունման դեպքում նա կգտնվի դատական վերահսկողության ներքո և կարող է ազատվել Փարիզի Լա Սանտե բանտից մի քանի ժամվա ընթացքում։
