Գյումրու քաղաքապետ Վարդան Ղուկասյանի պաշտպան Առնոլդ Վարդանյանը հանդես է եկել հայտարարությամբ.

«Թեև մի քանի օր է, ինչ որևէ իրավասու մարմին չի արձագանքել Գյումրիի քաղաքապետ Վարդան Ղուկասյանի պաշտպանների կողմից ուղարկված դիմումներին, սակայն ստորև կներկայացվի և կհիմնավորվի, թե ինչու՞ մասնագիտական առումով Վարդան Ղուկասյանին կալանքի տակ պահելն ակնհայտ ոչ իրավաչափ է թե’ ներպետական, թե’ միջազգային չափորոշիչների տեսանկյունից։

  1. Հակակոռուպցիոն դատարանի՝ 2025 թվականի հոկտեմբերի 21-ի որոշմամբ Վարդան Ղուկասյանի նկատմամբ որպես խափանման միջոց է կիրառվել կալանավորումը։
  2. Թե’ կալանավորումը որպես խափանման միջոց կիրառելու միջնորդությամբ, թե’ դատական նիստի ընթացքում, թե’ դատարանի որոշմամբ հերքվել է Վարդան Ղուկասյանի նկատմամբ որևէ այլընտրանքային խափանման միջոցի կիրառման հնարավորությունը։
  3. 2025 թվականի հոկտեմբերի 29-ին պաշտպանական խումբը ստացել է նույն օրով՝ 2025 թվականի հոկտեմբերի 21-ով թվագրված վարույթն իրականացնող մարմնի որոշում՝ Վարդան Ղուկասյանի նկատմամբ այլընտրանքային խափանման միջոցների՝ բացակայելու արգելքի հետ համակցված պաշտոնավարման կասեցում կիրառելու վերաբերյալ։

Ինչպես ՀՀ քրեական դատավարության օրենսգրքի 115-րդ հոդվածի, այնպես էլ նույն օրենսգրքի 122-րդ հոդվածի ուսումնասիրությունից ակնհայտ է, որ գոյություն ունի կալանք և դրան այլընտրանք հանդիսացող խափանման միջոցներ։ Այլընտրանքային խափանման միջոցները երբևէ չեն կարող համակցվել բացառիկ խափանման միջոց համարվող կալանքի հետ։ Այդ պատճառով են դրանք համարվում ԱՅԼԸՆՏՐԱՆՔ (օրինակ՝ չի կարող անձի նկատմամբ միաժամանակ կիրառվել կալանք և տնային կալանք)։ Այլընտրանքային ցանկացած խափանման միջոցի կամ միջոցների համակցված կիրառման դեպքում անձի նկատմամբ կալանավորումը ենթակա է անհապաղ վերացման, այն բացառում է կալանավորումը։

Թե’ Մարդու իրավունքների եվրոպական դատարանի վճիռների (տե’ս Idalov v. Russia, Shabani v. Switzerland), թե’ ՄԱԿ-ի Կամայական կալանավորման հարցերով աշխատանքային խմբի կարծիքների (տե’ս A/HRC/WGAD/2017/1, A/HRC/WGAD/2018/74 և այլն) համաձայն՝ կալանավորումը պետք է կիրառվի որպես վերջին միջոց (last resort), երբ այլընտրանքային խափանման միջոցներով հնարավոր չէ հասնել հետապնդվող նպատակին։ Ըստ այդմ, եթե կիրառվում են այլընտրանքային միջոցներ, կալանավորումը դադարում է որպես վերջին միջոց լինել իրավաչափ։

Հակառակ մոտեցումն ուղիղ ճանապարհ է դեպի «Մարդու իրավունքների և հիմնարար ազատությունների պաշտպանության մասին» եվրոպական կոնվենցիայի 5-րդ հոդվածի խախտման արձանագրում։

Այս ամենին նաև երեկ գումարվեց այն, որ առողջական վիճակի կտրուկ վատթարացմամբ պայմանավորված Վարդան Ղուկասյանը տեղափոխվեց «Սուրբ Գրիգոր Լուսավորիչ» ԲԿ, որտեղից, ըստ նախնական տեղեկությունների, առանց հետազոտություններն ամբողջությամբ ավարտելու արդեն ետ է տեղափոխվել ՔԿՀ։ Նրա առողջական վիճակը ժամանակին ևս պատշաճ իրավական գնահատման չէր ենթարկվել դատարանի կողմից ամենից ծանր՝ կալանավորումը որպես խափանման միջոց ընտրելիս։

2025 թվականի հոկտեմբերի 21-ից Գյումրիի քաղաքապետ Վարդան Ղուկասյանի ազատության իրավունքի սահմանափակումն իրավական առումով ակնհայտ ոչ իրավաչափ է, նա պետք է անհապաղ ազատ արձակվի իր նկատմամբ կիրառված այլընտրանքային խափանման միջոցների ուժով»։
