«Փաստ» օրաթերթը գրում է.

Պետական գույքի կառավարման կոմիտեն առաջարկում է լրացումներ կատարել կառավարության 2015 թվականի մարտի 19-ի N 596-Ն որոշման մեջ։

Ներկայիս իրավակարգավորումներով բացակայում են համայնքի վարչական սահմաններում ընդգրկվող պետական սեփականություն հանդիսացող հողամասում գտնվող շենքերը կամ շինությունները, այդ թվում՝ այլ իրավատիրոջ (սուբյեկտի) համաձայնությամբ նրան պատկանող հողամասում գտնվող պետական սեփականություն հանդիսացող շենքերը կամ շինությունները կառուցապատողների կողմից, ինչպես նաև պետական ոչ առևտրային կազմակերպությունների և (կամ) 100 տոկոս պետական մասնակցությամբ այլ կազմակերպությունների կողմից տնօրինվող պետական սեփականություն հանդիսացող շենքերը կամ շինությունները քանդելու համար կոմիտեից քանդման համաձայնություն ստանալու և կոմիտեի առաջարկությամբ կառավարության քանդման թույլտվություն տալու համաձայնության մասին որոշում կայացնելու վերաբերյալ կարգավորումները։ Սա տեխնիկական և իրավական առումով առաջացնում է մի շարք խնդիրներ, մասնավորապես՝ շենքերը և (կամ) շինությունները փաստացի ամրացված են լինում կոմիտեին, և կոմիտեն պատասխանատվություն է կրում դրանց արդյունավետ կառավարման համար, կամ ամրացված չեն լինում կոմիտեին, սակայն կոմիտեն, որպես լիազոր մարմին, ևս պատասխանատվություն է կրում նշված պետական գույքի արդյունավետ կառավարման համակարգման համար։

Մինչդեռ ներկայում առկա չէ որևէ կարգավորում, որի ուժով կոմիտեն օժտված է դրանք քանդելու համաձայնություն տրամադրելու լիազորությամբ, իսկ կառավարությունը, օժտված լինելով պետական գույքի կառավարման քաղաքականության մշակման ու իրականացման և դրա շրջանակներում պետական գույքի շրջանառության ու պետական շենքերի և շինությունների արդյունավետ օգտագործման վերաբերյալ որոշումներ կայացնելու իրավասությամբ, գործող իրավակարգավորումներով փաստացի զրկված է պետական շենքերը և շինություններն արդյունավետ օգտագործելու շրջանակներում դրանք քանդելու համաձայնության մասին որոշումներ ընդունելու հնարավորությունից, ինչը պետական գույքի արդյունավետ օգտագործման առումով ևս խնդրահարույց է և պրակտիկայում պետական գույքի արդյունավետ օգտագործման տեսանկյունից առաջացնում է տեխնիկական և իրավական խնդիրներ:

Գործող իրավական ակտում կատարվող լրացումների արդյունքում պետական շենքերը և (կամ) շինությունները կառուցապատողների կողմից քանդելիս վերանալու են ներկայիս տեխնիկական և իրավական առումով առաջացող խնդիրները, և բարձրանալու է կոմիտեի կողմից պետական գույքի արդյունավետ կառավարման, իսկ կառավարության կողմից՝ արդյունավետ օգտագործման մակարդակը:
