ՄԻՊ-ը անթույլատրելի է համարում մասնավոր կյանքի անձեռնմխելիության և անձնական տվյալների պաշտպանության իրավունքների համատարած խախտումները

Մարդու իրավունքների պաշտպան Անահիտ Մանասյանն անթույլատրելի է համարում մասնավոր կյանքի անձեռնմխելիության և անձնական տվյալների պաշտպանության իրավունքների համատարած խախտումներն ու դրանք կանխարգելելու ուղղությամբ բավարար քայլերի բացակայությունը։

Այս իրավունքները խախտվում են ամենօրյա ռեժիմով, բայց հատկապես մեծ ծավալներ ու տարածում են ստանում հանրային հնչեղություն ունեցող դեպքերով:

Ընդամենը շաբաթներ առաջ հանրային հնչեղություն ունեցող դեպքերից մեկով Մարդու իրավունքների պաշտպանը հրապարակային մտահոգություն էր հայտնել այս իրավունքների խախտման դեպքերի աճի մասին` արձանագրելով, որ մասնավոր կյանքին միջամտության դեպքերը հաճախ արտահայտվում են անձնական տվյալների կամ մասնավոր կյանքին վերաբերող տեղեկությունների ապօրինի ձեռքբերմամբ և/կամ ապօրինի տարածմամբ։

Անահիտ Մանասյանն ընդգծում է, որ օրենքով սահմանված կարգի խախտմամբ անձնական տվյալների հավաքագրումը կամ օրենքով սահմանված կարգի խախտմամբ անձնական տվյալների տարածումը ոչ միայն հակասում են Սահմանադրությանն ու միջազգային պարտավորություններին, այլև հանդիսանում են մարդու մի շարք հիմնարար իրավունքների խախտում։ Այդպիսի գործողությունները պետք է հանգեցնեն օրենքով սահմանված պատասխանատվության։

Անձնական տվյալների ապօրինի ձեռքբերման կամ ապօրինի տարածման հարցում դերակատարություն ունեն բոլոր սուբյեկտները, և խախտումները համատարած են Հայաստանի Հանրապետությունում: Միևնույն ժամանակ, Մարդու իրավունքների պաշտպանն ընդգծում է, որ պետությունն է պատասխանատու խախտումները կանխարգելելու կառուցակարգեր մշակելու, իսկ դեպքերի առկայության պարագայում` անձանց պատասխանատվության ենթարկելու հարցում:

Ուստի, Պաշտպանը պահանջում է իրավասու պետական մարմիններից պատշաճ քննության առարկա դարձնել մասնավոր կյանքի անձեռնմխելիության և անձնական տվյալների պաշտպանության իրավունքների խախտման դեպքերը:

Պաշտպանը պահանջում է նաև բոլոր շահագրգիռ սուբյեկտներից՝ պետական մարմիններից, կազմակերպություններից և քաղաքացիներից, խստորեն պահպանել անձնական տվյալների պաշտպանության և մասնավոր կյանքի անձեռնմխելիության իրավունքի երաշխիքները՝ տվյալներ հավաքել և տարածել բացառապես օրենքով նախատեսված հիմքերով և կարգով։

Մարդու իրավունքների պաշտպան Անահիտ Մանասյանն ընդգծում է, որ ցանկացած հարց կարող է դառնալ ժողովրդավարական բանավեճի առարկա, բայց դա չի կարող իրականացվել մարդու իրավունքների արժեքներին հակասող եղանակով: Անձնական տվյալների պաշտպանության ու մասնավոր կյանքի անձեռնմխելիության նկատմամբ հարգանքը ոչ թե պարզապես իրավական երաշխիքներ են, այլ արժեքներ, որոնց պահպանման մակարդակն ի ցույց է դնում նաև պետության ու հասարակության իրավական մշակույթը:
