Փաստաթուղթ․ Գյումրու ամբողջ քաղաքապետարանը և համայնքի բնակիչներին սկսել էին գաղտնալսել դեռևս մայիսից

AntiCor-ը ներկայացնում է փաստաթուղթ, համաձայն որի ՀՀ հակակոռուպցիոն կոմիտեի օպերատիվ-հետախուզական վարչության պետի որոշմամբ Գյումրու քաղաքապետարանում քաղաքապետի և բոլոր աշխատակիցների նկատմամբ օպերատիվ-հետախուզական միջոցառումները սկսվել են դեռևս 2025 թվականի մայիսից։
AntiCor-ի աղբյուրների փոխանցմամբ՝ Հակակոռուպցիոն կոմիտեի օպերատիվ-հետախուզական վարչության 4-րդ բաժնի ավագ օպերլիազորը գաղտնի միջնորդություն է ներկայացրել իր ղեկավարին՝ թույլտվություն ստանալու համար երկու ամսվա ընթացքում իրականացնել օպերատիվ-հետախուզական համալիր միջոցառումներ։ Դրանք ուղղված էին տեղեկություններ ստանալուն այն անձանց վերաբերյալ, ովքեր Գյումրու համայնքապետարանում կաշառք են ստացել կամ տվել, ինչպես նաև բացահայտելուն՝
- պաշտոնատար անձանց կողմից կաշառքի դիմաց կատարվող գործողությունները,
- նրանց օժանդակող անձանց շրջանակը,
- կաշառքի ստացման և տրամադրման հանգամանքները։
Միջնորդությամբ խնդրվել է թույլատրել միջոցառումների իրականացումը ինչպես բաց, այնպես էլ քողարկված եղանակով՝ Հայաստանի ողջ տարածքում գործող պետական մարմինների, իրավաբանական և ֆիզիկական անձանց շրջանակում։
Նշված միջնորդությունը բավարարվում է և տրվում թույլտվություն (փաստաթուղթը՝ ստորև)
Փաստացի ստացվում է, որ Գյումրիի մեծաթիվ բնակիչներ և պաշտոնատար անձինք ամիսներ շարունակ եղել են օպերատիվ-հետախուզական միջոցառումների թիրախում։
AntiCor-ին հայտնի է դարձել նաև, որ Հակակոռուպցիոն կոմիտեն չի սահմանափակվել այս որոշմամբ․ դատարան են ներկայացվել տասնյակ միջնորդություններ՝
- բնակարաններում և ավտոմեքենաներում ներքին դիտում իրականացնելու,
- արտաքին դիտում կազմակերպելու,
- և այլ գաղտնի միջոցառումներ իրականացնելու նպատակով։
Այս բոլոր միջնորդությունները, առանց բացառության, բավարարվել են Երևանի քրեական դատարանի դատավորներից մեկի կողմից։
Նշենք, որ դեռևս 2025 թվականի հոկտեմբերին, Ազգային ժողովի ամբիոնից Նիկոլ Փաշինյանը հայտարարեց, որ «հանրային կյանքից պետք է դուրս շպրտել Գյումրու քաղաքապետ Վարդան Ղուկասյանին»։
Սա նշանակում է, որ վարչապետը դեռ ամիսներ առաջ տեղյակ էր Գյումրու քաղաքապետի դեմ ընթացող օպերատիվ գործընթացների և ձայնագրությունների մասին, և ԱԺ ամբիոնից հնչեցրած հայտարարությամբ ուղղակիորեն քաղաքական հրահանգ է իջեցրել իրավապահ մարմիններին։
Այսպիսով՝ ամբողջ գործընթացը ստանում է բացահայտ քաղաքական ենթատեքստ։
Միջազգային իրավական պրակտիկայում նման երևույթները որակվում են որպես քաղաքական կոռուպցիա, որի վտանգն այն է, որ անգամ փաստացի մեղավորները կարող են արդարացվել, եթե ապացուցվի, որ քրեական հետապնդումը պայմանավորված է եղել քաղաքական նպատակներով։
