Իմ անձնական և մասնագիտական ընկալմամբ, առհասարակ խաղաղությունը առաջին հերթին ենթադրում է հումանիտար հարցերի ուղիղ հասցեագրում։ Այս մասին, այսօր՝ հոկտեմբերի 1–ին, Բաքվում պահվող հայ գերիների և պատանդների իրավունքների թեմայով քննարկմանն ասաց ԵՊՀ Միջազգային դատարաններ և արբիտրաժ մագիստրոսական ծրագրի ղեկավար Եղիշե Կիրակոսյանը՝ անդրադառնալով հարցին, թե ո՞րն է ավելի առաջնային՝ հումանիտար հարցերը լուծել, հետո անցնել խաղաղության պայմանագիր կնքելուն, թե՞ խաղաղության պայմանագիր կնքել, որը կարող է հեշտացնել այդ հումանիտար խնդիրների լուծումը
«Ես այդպես եմ պատկերացնում առհասարակ խաղաղության տրամաբանությունը, հատկապես գերեվարված անձանց, վերադարձի մասով։ Ինչո՞ւ են Ժնևյան կոնվենցիաները նախատեսում, որ գերիների անհապաղ վերադարձի պարտավորություն կա հակամարտող կողմերի միջև, հենց ամբողջ փիլիսոփայությունը դրա մեջ է, որ երբ դու դադարեցնում ես ռազմական գործողությունները, պարտավոր ես արագ վերադարձնել քո մոտ պահվող անձանց։ Դա հենց խաղաղության կարևոր կոմպոնենտներից մեկն է»,–ասաց նա։
Կիրակոսյանն ընդգծեց, որ իրավական պրոցեսները ինքնին խաղաղության կարևոր անկյունաքարն են, աղյուսն են, հիմքն են, դրա պատկերի կտորներից մեկն է իրավական պրոցեսները, որովհետև դա է նաև երաշխիք տալիս, որպեսզի, հատկապես բարդ և խոր պատմական հիմքեր ունեցող կոնֆլիկտի դեպքում, երբ դու ունես նաև փաստական առումով վեճեր, պատմական առումով որոշակի համաձայնություններ, դատական պրոցեսի նաև կարևորագույն իմաստներն էլ կայանում է հենց այդ փաստական հանգամանքների ապացուցման պրոցեսի միջոցով ապացուցել։
«Նման կոնֆլիկտների դեպքում կա նաև նարատիվների կռիվ և յուրաքանչյուր կողմը, հատկապես, ոչ այդքան դեմոկրատական ռեժիմները փորձում են իրենց չակերտավոր ճշմարտությունը սարքել գերիշխող և գերակայող։
Եթե մենք մտածում ենք միջազգային իրավունքի իմաստի մասին, միջազգային իրավունքի ամբողջ նորմատիվ համակարգի պահպանման իմաստը հենց խաղաղություն»,–ասաց Եղիշե Կիրակոսյանը։
