ՀԾԿՀ նախագահի գործողություններում առերևույթ առկա է 2 հանցակազմ․ փաստաբան

Հանրային ծառայությունները կարգավորող հանձնաժողովի նախագահի գործողությունները ինքնին կրում են ենթադրյալ հանցագործության հատկանիշներ։ Այս մասին հայտարարել է փաստաբան Արմեն Ֆերոյանը ՀԷՑ-ի հարցով հրավիրված մամուլի ասուլիսի ժամանակ՝ նշելով, որ փաստաբանական թիմը խորը ուսումնասիրության է ենթարկել հանձնաժողովի նախագահի գործողությունները։
Փաստաբանի փոխանցմամբ՝ խոսքը մասնավորապես պաշտոնական լիազորությունների չարաշահման մասին է։ «Երբ հանրահայտ արբիտրաժային դատարանի դատական ակտը հրապարակվեց և հասու դարձավ հանձնաժողովի նախագահին, վերջինս գրություն է հասցեագրում կառավարությանը և խնդրում պարզաբանել այդ դատական ակտի կատարման հետ կապված կառավարության դիրքորոշումը։ Այնուհետև այդ գրությունը մակագրվում է միջազգային հարցերով մասնագետին, ղեկավար անձնակազմին, ով պատասխանում է՝ շեշտադրելով, որ արբիտրաժային որոշման կատարումը պարտադիր բնույթ է կրում, և տվյալ դեպքում պետք է կասեցվեն ժամանակավոր կառավարչի լիազորությունները։ Սակայն անհասկանալիորեն հանձնաժողովի նախագահը մեր հասցեագրած գրությանը լրիվ այլ բովանդակության պատասխան է ներկայացնում, որն ընդհանրապես կապ չունի կառավարչի լիազորությունների կասեցման և արբիտրաժային որոշման կատարման հետ։ Դրա հետ կապված մենք նախապատրաստում ենք հանցագործության մասին հաղորդում», – ասաց փաստաբանը։
Վերջինիս խոսքով՝ գործ ունենք երկու հոդվածի հետ՝ ՀՀ քրեական օրենսգրքի 441-րդ հոդվածը՝ պաշտոնատար անձի կողմից պաշտոնեական լիազորությունների չարաշահում, և 507-րդ հոդվածը՝ դատական ակտը կամ դատարանի որոշումը չկատարելը։
«Մենք այս պահին ունենք նվազագույնը քրեական օրենսգրքով նախատեսված երկու հոդված, երկու հանցակազմ, որոնցով, ըստ էության, հանձնաժողովի նախագահի վարքագիծը քրեաիրավական կոնտեքստում տեղավորվում է այդ հոդվածների դիսպոզիցիայի մեջ։ Կարծում ենք, որ մոտ ապագայում հանցագործության մասին հաղորդում կներկայացնենք համապատասխան իրավասու մարմիններին՝ վերջնական դիրքորոշումները ձևավորելուց հետո։ Մինչ այդ ուզում եմ վերահաստատել այն մոտեցումը, որ օրենք խախտել ինչ-որ մեկին հաճոյանալու համար չի կարելի։ Շուտ թե ուշ, եթե մենք այսօր էլ հաղորդում չտանք հանցագործության մասին, վաղը կամ մյուս օրը կտանք, և այդ ենթադրյալ արարքը հանցագործություն լինելուց չի դադարում։ Դա, իհարկե, համարվելու է հանցագործություն՝ անմեղության կանխավարկածը չխախտելով։ Բոլոր իրավասու մարմիններին և պետական պաշտոնյաներին, որոնք օրենք են կիրառում, կոչ ենք անում ձեռնպահ մնալ օրենքի խախտումներից, քանի որ շուտ թե ուշ անպայմանորեն պատասխանատվության կենթարկվելու են», – ասաց նա։
