«Փաստ» օրաթերթը գրում է.

Ներքին գործերի նախարարությունն առաջարկում է փոփոխություն կատարել «Ոստիկանության մասին» օրենքում։ Ըստ այդմ, կառավարությունը կլիազորվի՝ սահմանելու Հայաստանի Հանրապետության ներքին գործերի նախարարության ոստիկանության ծառայողների կողմից բնակարանի կամ բնակելի տան ձեռքբերմանը կամ բնակելի տան կառուցմանը պետական աջակցության նպատակային ծրագիրը հաստատելու և Հայաստանի Հանրապետության ներքին գործերի նախարարության ոստիկանության ծառայողների կողմից բնակարանի կամ բնակելի տան ձեռքբերման կամ բնակելի տան կառուցման նպատակով մատչելի և արտոնյալ պայմաններով երկարաժամկետ հիփոթեքային վարկավորման կարգը և պայմանները։

Օրենքի 39-րդ հոդվածը նախատեսում է ոստիկանության ծառայողների սոցիալական ապահովության պետական երաշխիքները։ Սահմանադրության 6-րդ հոդվածի 1-ին մասի համաձայն՝ պետական և տեղական ինքնակառավարման մարմիններն ու պաշտոնատար անձինք իրավասու են կատարելու միայն այնպիսի գործողություններ, որոնց համար լիազորված են Սահմանադրությամբ կամ օրենքներով: Նույն հոդվածի 2-րդ մասի համաձայն՝ Սահմանադրության և օրենքների հիման վրա և դրանց իրականացումն ապահովելու նպատակով Սահմանադրությամբ նախատեսված մարմինները կարող են օրենքով լիազորվել ընդունելու ենթաօրենսդրական նորմատիվ իրավական ակտեր: Լիազորող նորմերը պետք է համապատասխանեն իրավական որոշակիության սկզբունքին:

Ներկայում ընթացող ներքին գործերի նախարարության ոստիկանության լայնամասշտաբ բարեփոխումների շրջանակներում, նպատակ ունենալով մեծացնելու գրավչությունը և բարձրացնելու հետաքրքրությունը ոստիկանությունում ծառայության անցնելու կամ ծառայությունը շարունակելու հարցերում, նախագծով առաջարկվում է կառավարության համար սահմանել վերոնշյալ լիազորող նորմը:

Նախագծով առաջարկվում է «Ոստիկանության մասին» օրենքի 39-րդ հոդվածը շարադրել հետևյալ խմբագրությամբ.

«1. Ոստիկանության ծառայողների սոցիալական ապահովության հարցերը կարգավորվում են «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքին համապատասխան, բացառությամբ սույն օրենքով նախատեսված դեպքերի:

2. Կառավարության սահմանած կարգով և պայմաններով ոստիկանության ծառայողները կարող են բնակարան կամ բնակելի տուն ձեռք բերելու կամ բնակելի տուն կառուցելու նպատակով օգտվել մատչելի և արտոնյալ պայմաններով երկարաժամկետ հիփոթեքային վարկավորման պետական նպատակային ծրագրերից:

3. Ոստիկանության ծառայողները կարող են ապահովվել նաև Հայաստանի Հանրապետության օրենսդրությամբ սահմանված սոցիալական ապահովության այլ երաշխիքներով»:
