«Փաստ» օրաթերթը գրում է.

Պարզվում է՝ ժամանակին հարսանիքից հետո երիտասարդ հարսնացուն անմիջապես չէր գնում ամուսնու տուն։ Նախ՝ նա պետք է հանդիպեր տիրոջը՝ լինի դա դուքս, կոմս, մարքիզ, արքայազն, թե պարզապես հողատեր, եթե ինքը ճորտ աղջիկ էր: Այդպիսին էր միջնադարի դաժան սովորույթը։

Ռուսաստանում և եվրոպական երկրներում այդ ծեսը, որը հայտնի է որպես «առաջին գիշերվա իրավունք», գոյություն է ունեցել դարեր շարու նակ և վերջնականապես անհետացել է, պատկերացրեք, միայն 19-րդ դարում:

Դժվար է որոշել այդ չգրված օրենքի ի հայտ գալու ստույգ ժամանակաշրջանը, քանի որ այն երբեք չի փաստաթղթավորվել։ Այնուամենայնիվ, այդ սովորույթի արմատները գնում են դեպի գերմանական ցեղերի ավանդույթներ, որտեղ հզոր մարտիկները հնարավորություն ունեին քնել իրենց ենթակաների կանանց հետ: Ընդ որում, նույնիսկ քրիստոնեության գալուստով այդ պրակտիկան չվերացավ: Դրա մասին առաջին հիշատակումները կարելի է գտնել 11-րդ դարի աղբյուրներում։

Առաջին գիշերվա իրավունքի ավանդույթի դեմ պայքարի վառ օրինակ է եղել Շոտլանդիայի թագուհի Մարգարեթը՝ Մալկոլմ III-ի կինը։ Նրա ծագումը մնում է առեղծված, բայց, անկախ դրանից, Մարգարեթը կիրթ, խորապես կրոնասեր, անբասիր, բարի կին էր։ Հենց նրան է հաջողվել հասնել այս սովորույթի վերացմանը Շոտլանդիայում՝ առաջարկելով փոխարինել այն կանխիկ փրկագնով: Փեսան պետք է վճարեր իր տիրոջը, որից հետո նա հրաժարվում էր իր իրավունքից։ Այնուամենայնիվ, նույնիսկ այդ պարագայում երաշխիք չկար, ուստի պետք էր հույս դնել միայն տիրոջ ջենտլմենական ազնվության վրա:

Ֆրանսիայում առաջին գիշերվա իրավունքի պրակտիկան շարունակվել է նույնիսկ 16-րդ դարում: Այստեղ ևս գործում էր փրկագնի պրակտիկան: Իր տիրույթներում տերը գրեթե անսահմանափակ իշխանություն ուներ, նա կարող էր դատել, պատժել, բանակ հավաքել և հաս տ ա տել իր կա նոն ն ե րը։ Չնա յ ա ծ դրան, ոմանք սահմանափակվում էին միայն ավանդույթի զուտ խորհրդանշական պահպանմամբ, օրինակ՝ որոշ պարոնայք պարզապես ձեռքն էին դնում ամուսնական մահճակալի վրա և անմիջապես դուրս գալիս սենյակից:

Պիրենեյան թերակղզում իսպանական հիդալգոները նույնպես հավատարիմ էին այդ նորմերին։ Սակայն դրանց վերացմանն ուղղված կարևոր քայլ է կատարել Արագոնի թագավոր Ֆերդինանդ II-ը։ 1468 թվականին նա հրամանագիր է արձակել, որն արգելում էր ոչ միայն բուն «առաջին գիշերվա իրավունքը», այլ նաև դրանից հրաժարվելու համար վճարման պահանջը։ Այդ քայլն իսկական բեկում էր, քանի որ Մարգարեթ Շոտլանդացու թագավորությունից միայն չորս դար անց հնարավոր եղավ հասնել ոչ միայն բուն ծեսի, այլ նաև դրա դրամական այլընտրանքի ամբողջական արգելքին։

Ռուսաստանում առա ջին գիշերվա իրավունքի պաշտոնական ճանաչում չկար, սա կայն պատմաբաններն ու գրողները բազմիցս են նկարագրել հողատերերի պահվածքը ճորտերի նկատմամբ։ Ֆեոդալիզմի այդ մնացորդն իր վերջնական նահանջը կատարել է միայն ճորտատիրության վերացումից հետո։
