60 մլն 562 հզր 666 ՀՀ դրամ գումարը հափշտակվել է. ինչ է պարզվել

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչությունում ավարտվել է Կադաստրի կոմիտեի «Գեոդեզիա և քարտեզագրություն» ՊՈԱԿ-ի նախկին տնօրենի կողմից, մի խումբ անձանց օժանդակությամբ, առանձնապես խոշոր չափերով հափշտակություն կատարելու դեպքի վերաբերյալ նախաձեռնված քրեական վարույթի նախաքննությունը։ Այս մասին հայտնել են քննչական կոմիտեից:
Քրեական վարույթի նախաքննության ընթացքում առերևույթ փաստական տվյալներ են ձեռք բերվել այն մասին, որ ՊՈԱԿ-ի նախկին տնօրենը, այլ աշխատակիցների օժանդակությամբ, կազմակերպությունում որպես աշխատողներ հրամանագրել է 37 անձանց, որոնց մի մասն աշխատանքի չի հաճախել, իսկ նրանց անվամբ որպես աշխատավարձ փոխանցված առանձնապես խոշոր չափերով՝ շուրջ 60 մլն 562 հզր 666 ՀՀ դրամ գումարը հափշտակվել է։
ՊՈԱԿ–ի նախկին տնօրենի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ Քրեական օրենսգրքի 256-րդ հոդվածի 3-րդ մասի 3-րդ կետով (առանձնապես խոշոր չափերով վստահված գույքը հափշտակելը) և 445-րդ հոդվածի 1-ին մասով (պաշտոնեական կեղծիքը), երկու անձի նկատմամբ՝ 46-256-րդ հոդվածի 3-րդ մասի 3-րդ կետով (առանձնապես խոշոր չափերով վստահված գույքը հափշտակելուն օժանդակելը) և երկու անձի նկատմամբ՝ 46-256-րդ հոդվածի 2-րդ մասի 2-րդ և 3-րդ կետերով (իշխանական կամ ծառայողական լիազորությունները կամ դրանցով պայմանավորված ազդեցությունն օգտագործելով խոշոր չափերով վստահված գույքը հափշտակելուն օժանդակելը)։
Մեկ անձի նկատմամբ որպես խափանման միջոց կիրառվել է վարչական հսկողությունը, չորս անձի նկատմամբ՝ բացակայելու արգելքը։
Քրեական վարույթի նախաքննության ընթացքում վերականգնվել է պետությանը պատճառված վնասից 26 մլն 497 հզր 427 ՀՀ դրամը։
Հինգ անձի վերաբերյալ քրեական վարույթը մեղադրական եզրակացությամբ ուղարկվել է հսկող դատախազին՝ այն հաստատելու և ըստ էության քննության առնելու համար դատարան ուղարկելու միջնորդությամբ։
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով։
