19 մլն դրամի վնաս է պատճառվել համայնքին. քրեական վարույթն ուղարկվել է դատարան
SOCIETYՍեղմեք ԱՅՍՏԵՂ, լրացրեք օնլայն հայտը և մոռացեք հոսանքի վարձի մասին
ՀՀ հակակոռուպցիոն կոմիտեում քննված քրեական վարույթի նախաքննությամբ հիմնավորվել է, որ 2004-2022 թվականների ընթացքում ՀՀ Շիրակի մարզի Անի համայնքի ղեկավարի պաշտոնը զբաղեցրած անձը, իր իշխանական և ծառայողական լիազորություններն ու դրանցով պայմանավորված ազդեցությունն ի վնաս ծառայողական շահերի օգտագործելով, 14,5 մլն և 5 մլն ՀՀ դրամ շուկայական արժեքներով համայնքապատկան շենք-շինությունները, առանց դրանց շուկայական արժեքների գնահատում իրականացնելու, կադաստրային և շուկայական արժեքներից անհամեմատ ցածր գներով ապօրինի օտարել է իր ազգականին: Այս մասին տեղեկացնում են ՀՀ Հակակոռուպցիոն կոմիտեից:
«Մասնավորապես, նախաքննությամբ պարզվել է, որ հիշյալ պաշտոնատար անձը, համայնքի ավագանու որոշմամբ տրված համաձայնության հիման վրա, կազմակերպել և իրականացրել է համայնքում գտնվող 1217,74 քմ անշարժ գույքի աճուրդով վաճառքը՝ որպես մեկնարկային գին սահմանելով կադաստրային արժեքից էականորեն ցածր՝ 608 հազ. ՀՀ դրամ գումարը: Արդյունքում՝ համայնքի ղեկավարը նշված գույքը կադաստրային արժեքից 8 մլն ՀՀ դրամով պակաս, այն է՝ 812 հազ. դրամով օտարել է իր ազգականին՝ համայնքի օրինական շահերին պատճառելով շուրջ 14,5 մլն ՀՀ դրամի գույքային վնաս:
Բացի այդ, պարզվել է, որ համայնքի ղեկավարը կազմակերպել և իրականացրել է տվյալ համայնքում գտնվող ևս մեկ՝ 649,14 քմ. մակերեսով, 5 մլն ՀՀ դրամ շուկայական արժեքով, համայնքային սեփականություն հանդիսացող անշարժ գույքի աճուրդով վաճառքը: Արդյունքում՝ հիշյալ անշարժ գույքը կադաստրային արժեքից շուրջ 3 մլն ՀՀ դրամով պակաս, այն է՝ 352.000 ՀՀ դրամով կրկին օտարել է իր ազգականին՝ համայնքի օրինական շահերին պատճառելով շուրջ 5 մլն ՀՀ դրամի գույքային վնաս:
Վերը նշված հանցավոր արարքների կատարման համար Անի համայնքի նախկին ղեկավարին մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 441-րդ հոդվածի 1-ին մասով (2 դրվագ):
Քրեական վարույթով նախաքննությունն ավարտվել է, և վարույթի նյութերը մեղադրական եզրակացությամբ ուղարկվել են ՀՀ հակակոռուպցիոն դատարան:
Ի դեպ, հարկ է նշել, որ 2025 թվականի հունվարի 1-ից օգոստոսի 14-ն ընկած ժամանակահատվածում մեղադրական եզրակացությամբ դատարան է ուղարկվել 12 քրեական վարույթ 13 համայնքների ղեկավարների վերաբերյալ: Նրանց թվում են Կոտայքի մարզի Պտղնի և Աբովյան, Տավուշի մարզի Իջևան, Արագածոտնի մարզի Բյուրական, Արարատի մարզի Նոր Խարբերդ և Գոռավան համայնքների նախկին ղեկավարները:
Ընդհանուր առմամբ՝ հաշվետու ժամանակահատվածում ավարտված քրեական վարույթներով համայնքին պատճառված գույքային վնասը կազմել է ավելի քան 424 միլիոն ՀՀ դրամ, որից փաստացի դրամական տեսքով վերականգնվել է շուրջ 7 մլն ՀՀ դրամը, իսկ 159 մլն ՀՀ դրամ արժողությամբ 9 հողատարածք վերականգնվել է գույքի տեսքով»,- ասված է հաղորդագրությունում:
