Քանաքեռ-Զեյթուն համայնքի նախկին թաղապետն ապօրինի օտարել է թիվ 147 մանկապարտեզը

Դատախազը 2025 թվականի հուլիսի 28-ին Հակակոռուպցիոն դատարան է հանձնել պաշտոնեական դիրքն օգտագործելով, վատնելու եղանակով թիվ 147 մանկապարտեզն օտարած՝ Երևան քաղաքի Քանաքեռ-Զեյթուն համայնքի նախկին թաղապետ Ա.Ք.-ի վերաբերյալ հաստատված մեղադրական եզրակացությամբ վարույթի նյութերը:
Քննչական կոմիտեում քննված վարույթով պարզվել է, որ Ա.Ք.-ն, ի պաշտոնե ունենալով համայնքի գույքը տնօրինելու լիազորություն, հանդիսանալով Երևան քաղաքի Դրոյի 21Ա շենքի 1-ին հարկի 141 քմ տարածքի՝ համայնքային սեփականություն հանդիսացող գույքի օտարման պատասխանատուն, 2006 թվականի նոյեմբերի 10-ին ստորագրել է համայնքի ավագանու թիվ 86 որոշումը: Համաձայն այդ որոշման՝ համայնքային սեփականություն հանդիսացող մանկապարտեզի 141 քմ տարածքը, առանց գույքի գնահատման, 1 միլիոն 910 հազար 250 դրամով (1 քմ-ն՝ 13 հազար 500 դրամով) օտարվել է ձեռնարկատիրական գործունեությամբ զբաղվող ՍՊ ընկերությանն, այն դեպքում, երբ գույքի իրական շուկայական արժեքը կազմել է 16 միլիոն 100 հազար դրամ:
2007 թվականի հունվարի 24-ին Քանաքեռ-Զեյթուն թաղային համայնքի՝ ի դեմս թաղապետ Ա.Ք.-ի և ՍՊ ընկերության տնօրենի միջև կնքվել է առուվաճառքի պայմանագիր, որով գույքը ՍՊ ընկերությանն է օտարվել 1 միլիոն 910 հազար 250 դրամով:
Արդյունքում, Երևան քաղաքի Քանաքեռ-Զեյթուն համայնքի նախկին թաղապետ Ա.Ք.-ն, պաշտոնեական դիրքն օգտագործելով, վատնելու եղանակով հափշտակել է ի պաշտոնե իրեն վստահված գույքը՝ համայնքին պատճառելով առանձնապես խոշոր չափի՝ 14 միլիոն 189 հազար 750 դրամի վնաս:
2025 թվականի հուլիսի 25-ին Ա.Ք.-ի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ 18.04.2003 թվականին ընդունված Քրեական օրենսգրքի 179-րդ հոդվածի 3-րդ մասի 1-ին կետով:
Նույն օրը մեղադրյալ Ա.Ք.-ի վերաբերյալ գործն անջատվել է և 2025 թվականի հուլիսի 28-ին քրեական վարույթը հաստատված մեղադրական եզրակացությամբ հանձնվել է Հակակոռուպցիոն դատարան:
Գլխավոր դատախազությունն առաջիկայում, պետական (hամայնքային) շահերի պաշտպանության հայց կներկայացնի դատարան:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
