Հակակոռոպցիոն կոմիտեն ու դատախազությունը որոշել են Նիկոլ Փաշինյանի նկատմամբ քրեական վարույթ չնախաձեռնել. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Ինչպես հայտնի է, հուլիսի 8-ին «ՀայաՔվե» ազգային քաղաքացիական միավորումը հանցագործության մասին հաղորդում է ներկայացրել ՀՀ գլխավոր դատախազություն՝ պահանջելով, որ գլխավոր դատախազը քրեական վարույթ նախաձեռնի Նիկոլ Փաշինյանի և իշխող կուսակցության մի շարք անդամների կողմից Հայ առաքելական եկեղեցու դեմ ուղղված արշավի հետ կապված հանցագործությունների փաստերի վերաբերյալ:
«ՀՀ վարչապետի պաշտոնը զբաղեցնող Նիկոլ Փաշինյանն ու նրա հետ փոխկապակցված անձինք սկսել են կազմակերպված գրոհ Հայ առաքելական եկեղեցու դեմ։ Դա արտահայտվում է տարաբնույթ ելույթներով, կոչերով ու մեկնաբանություններով, որոնք փորձում են տպավորություն ստեղծել, որ եկեղեցին ոչ թե եկեղեցի է, այլ ընդհուպ մինչև ահաբեկչական կենտրոն։ Իշխանության տարաբնույթ հայտարարությունները վերաբերում են Քրեական օրենսգրքի միանգամից մի քանի հոդվածների հանցակազմի` ատելության խոսք, կրոնական կազմակերպության աշխատանքին միջամտում, անձի անձնական գաղտնիքի բացահայտում, ինչպես նաև պաշտոնական լիազորությունների չարաշահում»,- նշել էր «ՀայաՔվե» միավորման համակարգող Ավետիք Չալաբյանը:
«Փաստը» հարցում էր ուղարկել ՀՀ գլխավոր դատախազություն՝ խնդրելով նշել, թե ինչ ընթացք է ստացել նշյալ հաղորդումը: Երեկ դատախազությունից ստացել ենք պատասխան, որտեղ նշվում է. «ՀՀ հակակոռուպցիոն կոմիտեի քննիչի կողմից վարույթ չնախաձեռնելու որոշում է կայացվել՝ Քրեական դատավարության 173-րդ հողվածի 2-րդ մասի հիմքով, որը հաստատվել է հսկող դատախազի կողմից»:
Ի՞նչ է ասում այդ հոդվածը. «Համապատասխան հաղորդումը համարվում է առերևույթ հանցանքի մասին, եթե դրանով փաստվում է այնպիսի դեպք կամ գործողություն կամ անգործություն, որին ողջամտորեն կարող է տրվել Հայաստանի Հան ր ա պ ե տու թյան քրե ա կ ա ն օրենսգրքով նախատեսված որևէ արարքին համապատասխանելու նախնական իրավական գնահատական»: Այսինքն, ՀՀ հակակոռուպցիոն կոմիտեն և դատախազությունը Նիկոլ Փաշինյանի ու նրա թիմակիցների հակաեկեղեցական հայտարարություններում ու գործողություններում ՀՀ քրեական օրենսգրքով նախատեսված որևէ արարքին համապատասխանություն չեն տեսել:
«Փաստը» զրուցեց Ավետիք Չալաբյանի հետ՝ խնդրելով մեկնաբանել այս որոշումը: «Մենք չէինք էլ կասկածում, որ Նիկոլ Փաշինյանին ենթարկվող այս կառույցները Փաշինյանի դեմ վարույթ չեն նախաձեռնելու: Նման որոշումը զարմանալի չէր: Բայց մենք մինչև վերջ գնալու ենք ու, որպես հաջորդ քայլ, դիմելու ենք դատարան»,-մեզ հետ զրույցում ասաց «ՀայաՔվե» ազգային քաղաքացիական միավորման համակարգողը:
