«Փաստ» օրաթերթը գրում է.

Արդարադատության նախարարության՝ հանրային քննարկման ներկայացված փաթեթով առաջարկվում է կատարելագործել հանրության գերակա շահ ճանաչելու վերաբերյալ կարգավորումները, ինչի արդյունքում, ըստ նախարարության, կբարձրանա կառավարության համապատասխան որոշումների հիմնավորվածությունը, կբարելավվեն ու կհստակեցվեն վարույթային և դատավարական ընթացակարգերը:

Նախագծերի փաթեթով առաջարկվում է, օրինակ՝ օտարվող գույքերի սեփականատերերի համար նախատեսել ձեռքբերողի կողմից առաջարկվող փոխհատուցման չափին համաձայնելու համար խրախուսական գործիքակազմ՝ սահմանելով գործող կարգավորման համեմատությամբ ևս 15 տոկոս ավելի բարձր չափով փոխհատուցում ստանալու հնարավորություն (փաստացի՝ շուկայական արժեքից 30 տոկոս ավելի)։ Օտարվող գույքի սեփականատերերի և գույքային իրավունքներ ունեցող այլ անձանց համար կերաշխավորվեն սեփականության գնահատման գործընթացում առավել մրցակցային հնարավորություններ՝ հնարավորություն տալով սեփականության գնահատումից հետո մեկամսյա ժամկետում ներկայացնել գնահատման նոր հաշվետվություն, որով գույքի գնահատված շուկայական արժեքը սկզբնական գնահատումից ավելի բարձր լինելու դեպքում սեփականատիրոջ համար կապահովվի սկզբնական գնահատմամբ արձանագրված շուկայական արժեքից մինչև տասը տոկոս ավելի բարձր փոխհատուցում։

Առաջարկվում է կատարելագործել հանրության գերակա շահ ճանաչելու վերաբերյալ կառավարության որոշումները Վարչական դատարանում վիճարկելու վերաբերյալ կարգավորումները՝ հստակեցնելով որոշումների վիճարկման ժամկետները, Վարչական դատավարության օրենսգրքում նշված որոշումների վիճարկման հարաբերությունները կարգավորել առանձին գլխով:

Սահմանվում է, որ սեփականատերը հնարավորություն ունի հայց ներկայացնել դատարան և փոխհատուցման չափը վիճարկել դատարանում՝ ամբողջական, դատավարական անհրաժեշտ բոլոր երաշխիքներով: Գործող օրենսդրության համեմատությամբ սեփականատիրոջ համար կսահմանվի խրախուսական գործիքակազմ՝ կամովին պայմանագիր կնքելու և որոշակի այլ պայմանների դեպքում հավելյալ փոխհատուցում ստանալու, մասնավորապես՝ սահմանելով, որ եթե սեփականատերը չի խոչընդոտում սեփականության նկարագրության արձանագրության կազմման նպատակով օտարվող սեփականություն մուտք գործելուն կամ այլ կերպ անհնարին չի դարձնում օտարվող սեփականության հասանելիությունը, ձեռքբերողի հետ կնքում է պայմանագիրը ու սահմանված ժամկետում և կարգով ազատում է օտարվող գույքը և հանձնում ձեռքբերողին (չի խոչընդոտում կամ այլ կերպ անհնարին չի դարձնում գույքի հանձնումը), ապա սեփականատիրոջը վճարվող համարժեք փոխհատուցման չափ է համարվում օտարվող գույքի շուկայական արժեքից երեսուն տոկոսով ավելի գումարը:
