ՄԻՊ աշխատակազմում ամփոփվում են Ոստիկանության բաժիններ իրականացված արագ արձագանքման այցերի արդյունքները։
Գրասենյակից հայտնում են, որ իրականացված արագ արձագանքման այցերի շրջանակում պարզվել է, որ մի շարք անձինք ձերբակալվել են արդարադատության իրականացմանը խոչընդոտելու անմիջական ծագած կասկածի հիմքով։ Պարզվել է նաև, որ ձերբակալված անձանց թվում կան նաև անչափահասներ։ Ազատությունից զրկված անձանց հետ տեղի ունեցած առանձնազրույցների ընթացքում վերջիններս բարձրացել են մի շարք հարցեր, որոնց մի մասը Ոստիկանության ներկայացուցիչների հետ ՄԻՊ ներկայացուցիչների քննարկման արդյունքում ստացել է լուծում։
Միևնույն ժամանակ, ազատությունից զրկված անձինք ներկայացրել են իրենց անհամաձայնությունն իրականացված ձերբակալումների իրավաչափության, այդ թվում՝ ըստ իրենց` արդարադատության իրականացմանը որևէ ձևով միջամտելուն ուղղված գործողություններ չիրականացնելու պայմաններում՝ իրենց անհիմն ազատությունից զրկելու հարցերի վերաբերյալ։
Պաշտպանը կրկին ընդգծում է, որ անձին ազատությունից զրկելիս անհրաժեշտ է խստագույնս պահպանել ՀՀ քրեական դատավարության օրենսգրքով նախատեսված կարգավորումներն ու նշված ինստիտուտի հիմքում ընկած տրամաբանությունը՝ առաջնորդվել Մարդու իրավունքների եվրոպական դատարանի և ՀՀ ներպետական դատական ատյանների համապատասխան իրավական դիրքորոշումներով՝ բացառելով հիմքերի բացակայության դեպքում անձին ազատությունից զրկելը։
Մտահոգիչ է, որ ձերբակալված անձանց թվում եղել են նաև անչափահասներ։ Հարցի առնչությամբ Մարդու իրավունքների պաշտպանը խիստ կարևորում է, որ նշված գործընթացում յուրաքանչյուր անչափահասի ազատությունից զրկումը կիրառվի որպես վերջին միջոց և հնարավորինս կարճ ժամկետով, նրանց հետ ցանկացած գործողություն իրականացվի` հաշվի առնելով նրանց տարիքը, խոցելիությունը և զարգացման կարիքները։
Ծայրահեղ անհրաժեշտության դեպքում անչափահասներին ազատությունից զրկելիս նրանք պետք է անմիջապես առանձնացվեն մեծահասակներից՝ երաշխավորելով նրանց ֆիզիկական և հոգեբանական անվտանգությունը: Անչափահասներին պետք է անհապաղ տրամադրվի իրենց ծնողների կամ օրինական ներկայացուցիչների հետ կապ հաստատելու, իրավաբանական օգնություն ստանալու հնարավորություն։
Իրականացված այցերի ընթացքում բարձրացված խնդիրների վերաբերյալ իրավասու մարմիններից գրավոր պարզաբանումներ ստացվելուց հետո, ըստ անհրաժեշտության, ՄԻՊ աշխատակազմը հանդես կգա հրապարակային։
