Անձին ազատությունից զրկելիս անհրաժեշտ է խստագույնս պահպանել ՀՀ քրեական դատավարության օրենսգրքով նախատեսված կարգավորումներն ու նշված ինստիտուտի հիմքում ընկած տրամաբանությունը. ՄԻՊ

Մարդու իրավունքների պաշտպանի աշխատակազմում սոցիալական ցանցերի և զանգվածային լրատվության միջոցների հրապարակումների մշտադիտարկման արդյունքում տեղեկություն է ստացվել առ այն, որ Երևանում և ՀՀ մարզերում տեղի են ունեցել մի շարք ձերբակալություններ։ ՄԻՊ աշխատակազմի թեժ գծին ևս ահազանգ է ստացվել` կապված ազատությունից զրկված անձանց տեղափոխման վայրը հայտնի չլինելու հանգամանքի հետ: Այս մասին տեղեկացնում է Մարդու իրավունքների պաշտպանի
աշխատակազմի հանրային կապերի բաժինը: 

«Պաշտպանի հանձնարարությամբ ստացված տեղեկությունները հընթացս ուսումնասիրվում են՝ պարզելու ազատությունից զրկված անձանց իրավունքների հնարավոր խախտումները։ Արդյունքների հիման վրա, Մարդու իրավունքների պաշտպանի լիազորությունների շրջանակներում ձեռնարկվում են անհրաժեշտ քայլեր:

Պաշտպանը վերահաստատում է իր դիրքորոշումն առ այն, որ անձին ազատությունից զրկելիս անհրաժեշտ է խստագույնս պահպանել ՀՀ քրեական դատավարության օրենսգրքով նախատեսված կարգավորումներն ու նշված ինստիտուտի հիմքում ընկած տրամաբանությունը՝ առաջնորդվել Մարդու իրավունքների եվրոպական դատարանի և ՀՀ ներպետական դատական ատյանների համապատասխան իրավական դիրքորոշումներով՝ բացառելով հիմքերի բացակայության դեպքում անձին ազատությունից զրկելու պրակտիկան։

ՄԻՊ աշխատակազմի թեժ գիծ հեռախոսահամարին շարունակում են ստացվել ահազանգեր նաև այն մասին, որ դեռևս հունիսի 18-ից մի շարք տրանսպորտային միջոցներ շարունակում են մնալ Ոստիկանության հատուկ տարածքում: Մարդու իրավունքների պաշտպանը մշտապես է անդրադառնում վերոնշյալ խնդիրին, այդ թվում` տարեկան հաղորդումներում։

Նշված դեպքերով Պաշտպանը պարզաբանումներ է պահանջել իրավասու պետական մարմնից և դրանց վերլուծության արդյունքում կներկայացնի խնդրի առնչությամբ իր դիրքորոշումը: Մարդու իրավունքների պաշտպանն ընդգծում է, որ տրանսպորտային միջոցները հատուկ տարածք կարող են բերման ենթարկվել և արգելանքի տակ դրվել բացառապես համապատասխան իրավական հիմքերի առկայությամբ և դրանք քաղաքացիներին ներկայացնելով, իսկ տևական ժամանակ անհիմն կամ ծրագրային, տեխնիկական խնդիրների պատճառաբանությամբ օրինական տիրապետողին տրանսպորտային միջոցը չվերադարձնելը կարող է խնդրահարույց իրավիճակներ ձևավորել մարդու իրավունքների տեսանկյունից:  Ուստի, Պաշտպանը կարևորում է, որպեսզի խստորեն պահպանվեն տրանսպորտային միջոցները պահպանվող հատուկ տարածք տեղափոխելու և արգելանքի տակ դնելու համար օրենքով նախատեսված պահանջները», -նշվում է հայտարարության մեջ։
