Բանկային ու հարակից գաղտնիք պարունակող տեղեկատվության տրամադրումն իրավապահ մարմիններին կիրականացվի նաև էլեկտրոնային հարթակ-համակարգի միջոցով. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Արդարադատության նախարարությունն առաջարկում է լրացումներ և փոփոխություններ կատարել Քրեական դատավարության օրենսգրքում, «Բանկային գաղտնիքի մասին», «Ապահովագրության և ապահովագրական գործունեության մասին» «Կուտակային կենսաթոշակների մասին» օրենքներում։ Նախագիծը մշակել է Կենտրոնական բանկը։
«Բանկային գաղտնիքի մասին» օրենքի կարգավորումների համաձայն՝ բանկերը բանկային գաղտնիք կազմող տեղեկությունները քրեական հետապնդում իրականացնող մարմիններին տրամադրում են միայն դատարանի որոշման հիման վրա՝ «Բանկային գաղտնիքի մասին» օրենքին և Քրեական դատավարության օրենսգրքին համապատասխան: Նույն օրենսգրքի կարգավորումների համաձայն՝ բացառապես դատարանի որոշման հիման վրա է կատարվում բժշկական, նոտարական, բանկային կամ հարակից գաղտնիք պարունակող փաստաթղթերի և առարկաների առգրավումը։ Օրենսդրական մի շարք փոփոխությունների, ինչպես նաև նոր իրավական ակտերի ընդունման արդյունքում (օրինակ՝ «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին», «Հակակոռուպցիոն կոմիտեի մասին» օրենքներ) բանկային գաղտնիք կազմող տեղեկությունների ստացման (առգրավման) որոշումները գրեթե քառապատկվել են։ Ծավալների շեշտակի աճով պայմանավորված՝ նշված տեղեկատվության մշակման ու պատրաստման վրա ծախսվող ժամանակը և ռեսուրսները ևս ավելացել են, ինչը դժվարացրել է թե՛ իրավապահ համակարգի, թե՛ ֆինանսական կազմակերպությունների աշխատանքը՝ հանգեցնելով նաև պահանջվող տեղեկատվության տրամադրման համար նախատեսված անհրաժեշտ ժամկետների հետաձգման: Ավելի կոնկրետ՝ ներկայում գործընթացը իրականացվում է ամբողջությամբ թղթային եղանակով, որը խոչընդոտում է և/կամ դժվարացնում է քրեական վարույթի իրականացումը, առաջանում են նաև գործերի քննության ողջամիտ ժամկետների պահպանման խնդիրներ:
Նախագծով առաջարկվող իրավակարգավորումները հնարավորություն կտան բանկային և հարակից գաղտնիք պարունակող տեղեկությունների ստացման գործընթացն իրականացնել նաև էլեկտրոնային փաստաթղթաշրջանառության համակարգի միջոցով, որի շահագործման և անվտանգության կանոնները սահմանվելու է արդարադատության նախարարության և կենտրոնական բանկի համատեղ իրավական ակտով։ Սա կնպաստի տեղեկատվության մշակման ու պատրաստման վրա ծախսվող ժամանակը և ռեսուրսները կրճատելուն, ինչը հնարավորություն կտա դատարանի կողմից նշված ժամկետներում վարույթն իրականացնող մարմնին տրամադրել պահանջվող բանկային և հարակից գաղտնիք պարուկանող տեղեկատվությունը՝ այդպիսով նպաստելով նաև գործի քննության ողջամիտ ժամկետի սկզբունքի պահպանմանը:
