Ապօրինի գույքի օրենքը խնդիրներ է հարուցելու իշխանության համար

Ապօրինի գույքի բռնագանձման օրինագիծը, որ օրենքը դեռ երկար ժամանակ խնդիրներ է հարուցելու ոչ միայն Հայաստանի գործող իշխանությունների, այլ նաև, ընդհանրապես, Հայաստան պետության համար։ Երեկ դատախազությունը հրաժարվել է քաղաքաշինության կոմիտեի նախկին նախագահ Վահագն Վերմիշյանի դեմ ներկայացված հայցերից։ Ըստ Վերմիշյանի փաստաբանի, սա իրավական առումով լուրջ նախադեպ է և փաստում է, որ պատասխանող կողմը կարողացել է համոզիչ ներկայացնել գործի փաստական հիմքերը և ապացուցել, որ ներկայացված հայցը չուներ բավարար ապացուցողական հիմք։

Փաստացի, դատախազությունն է արձանագրել, որ ապօրինի դատավարական հետապնդում է իրականացվել Վահագն Վերմիշյանի նկատմամբ։ Հիշեցնենք, դեռ 2023 թվականի հունիսին դատախազությունը հայց է ներկայացրել՝ Վերմիշյանից՝ պահանջելով բռնագրավել 4 անշարժ գույք և 46 միլիոն դրամ։ Ընդ որում, Վերմիշյանի դեմ ներկայացված հայցը ամենափոքրերից մեկն էր, այլ նախկին պաշտոնյաներից ահռելի ունեցվածքներ են պահանջում։ Շատ դեպքերում էլ այդ գործերը խնդրահարույց են և իշխանությունները չունեն բավարար ապացույցներ՝ դրանք փաստարկելու համար։

Փաստացի, միայն Վերմիշյանի գործով արդեն իսկ ակնհայտ է, որ օրենքը լրջագույն խնդիրներ ունի, առավել ևս Սահմանադրական դատարանի կողմից վերջերս ընդունված կարգավորումները բավականին բարդացնելու են գործող իշխանությունների հնարավորությունները ապօրինի գույքի բռնագանձման հարցով, և հերթական անգամ վկայելու են, որ փաշինյանական իշխանությունը՝ հանրությանը կեղծ խոստումներով կերակրելով, իրականում շատերի նկատմամբ ապօրինի հետապնդում է իրականացրել։
