Արցախի Մարտունի քաղաքում nչնչացվել է Գարեգին Նժդեհի հուշարձանը

Արցախի մշակութային ժառանգության մշտադիտարկում իրականացնող monumentwatch.org կայքը գրում է.
Ադրբեջանում Կովկասի պատմության կենտրոնի տնօրեն Ռիզվան Հուսեյնովը 2025 թվականի մայիսի 17-ին իր տելեգրամյան ալիքում իր իսկ մեկնաբանությամբ ու մասնակցությամբ տեսանյութ է հրապարակել, որտեղ hայտնում է Գարեգի Նժդեհի հուշարձանի ոչնչացման մասին՝ ներկայացնելով հերոսին որպես Ֆաշիստ, իսկ հուշարձանի ոչնչացումը որպես հերոսություն։ Հուսեյնովը նշում է նաև ՀՀ և Արցախի ազգային հերոս Մոնթե Մելքոնյանի հուշարձանի ոչնչացման մասին։
Հարկ է նշել, որ ազգային հերոս Գարեգին Նժդեհի հուշարձանը գտնվում էր Արցախի Մարտունի քաղաքում։ Այն քանդակվել էր քանդակագործ Արմեն Պետրոսյանի կողմից և տեղադրվել 2020 թվականի սեպտեմբերի 26-ին։
Արցախի Մարտունու շրջանում տեղակայված Գարեգին Նժդեհի արձանի ոչնչացումը «Զինված հակամարտությունների ժամանակ մշակութային արժեքների պաշտպանության մասին» Հաագայի 1954 թ. կոնվենցիայի 4-րդ հոդվածի և լրացուցիչ՝ 1999 թ. ընդունված Երկրորդ արձանագրության խախտում է։
Այն խախտում է նաև Հաագայի Արդարադատության միջազգային դատարանի պարտադիր ուժ ունեցող 2021 թվկանի դեկտեմբերի 7-ի որոշումները, որով դատարանը պարտավորեցրել է Ադրբեջանին ձեռնարկել բոլոր անհրաժեշտ միջոցները՝ կանխելու և պատժելու վանդալիզմի և պղծման գործողությունները, որոնք վերաբերում են հայկական մշակութային ժառանգությանը, ներառելով, բայց չսահմանափակվելով միայն եկեղեցիներով և պաշտամունքի այլ վայրերով, հուշարձաններով, տեսարժան վայրերով, գերեզմանատներով և արտեֆակտներով https://www.icj-cij.org/public/files/case-related/180/180-20211207-PRE-01-00-EN.pdf
Հուշարձանի ոչնչացումը նաև խախտում է Միջազգային մարդասիրական իրավունքի 38-րդ, 39-րդ, 40-րդ և 41-րդ կանոնները։ Հույժ կարևոր է ընդգծել այն հանգամանքը, որ Արդարադատության միջազգային դատարանը հաստատել է, որ օկուպացված տարածքներում գործող օրենքները՝ ներառյալ մշակութային արժեքների պաշտպանության դրույթները, ձեռք են բերել միջազգային սովորութային իրավունքի (infra Jurisprudence) կարգավիճակ, այսինքն գործում են որպես համընդհանուր և անշրջանցելի կանոն և պարտադիր են բոլոր պետությունների համար։
