«Վերջին օրերին կրկին շատ էր խոսվում «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի մասին: Որոշման մասին խոսեցին գործադիր իշխանության անդամները, քաղաքական գործիչներ և այլն: Կարճ օբյեկտիվ արձագանքը հետևյալն է. Սահմանադրական դատարանի որոշումից հետո բազմաթիվ այս օրենքի հիման վրա հարուցված գործեր մերժվելու են, քանի որ ՍԴ որոշման և գործնականում առկա մեկնաբանությունները ուղիղ հակասության մեջ են»,-գրում է փաստաբան Արամ Վարդևանյանը։

Նա մանրամասնում է.

«Ավելին՝ փաստացի ապօրինի գույքի բռնագրավվման ինստիտուտը 2003 թվականից քրեական օրենսգրքով ներդրվել է, հետևաբար ողջամիտ է, որ այն պետք է զարգացում ստանար: Զարգացումը չէր կարող լինել հակասահմանադրական ճանապարհով, որը որոշակիորեն կանխվեց ՍԴ որոշմամբ: Ի դեպ ՍԴ որոշմամբ առկա է ուղիղ պահանջ հասցեագրված հենց Օրենսդրին, որի մասին չի խոսվում:

Սահմանադրական դատարան ուղիղ պահանջ է ներկայացրել այս մեխանիզմի վերաբերյալ՝ վաղեմության ժամկետ սահմանել, ինչը էական է լինելու բոլոր գործերի համար, այդ թվում իրավական կանխատեսելիության և որոշակիության մասով: Ուշագրավ է, որ արդեն անցել է 30 օր, խոսվել է ՍԴ որոշումից և ամեն ինչից, սակայն նույնիսկ Օրենքի նախագիծ դեռևս առկա չէ:

Ուղիղ մեջբերում ՍԴ որոշումից. Այս առումով Սահմանադրական դատարանը գտնում է, որ օրենսդիրը պարտավոր է համաչափ և կանխատեսելի կարգավորումներով որոշակիացնել Օրենքով նախատեսված ժամանակահատվածը Օրենքի ընթացակարգերի կիրառման համար վաղեմություն սահմանելու նպատակով…ժամանակային երկու պայմանական ռեժիմները՝ (1) Օրենքի ուժի մեջ մտնելուց առաջ և (2) Օրենքի ուժի մեջ մտնելուց հետո»։
