Դիլիջան համայնքի Շահումյան փողոցի թիվ 34 հասցեում գտնվող՝ 85 միլիոն 935 հազար դրամ շուկայականին մոտարկված կադաստրային արժեքով, 891,1 քմ մակերեսով անշարժ գույքը՝ մանկապարտեզի մասնաշենքը, վերադարձվել է Դիլիջան համայնքին։

Տավուշի մարզի դատախազությունը, պետական (համայնքային) շահերի պաշտպանության լիազորության շրջանակում, ուսումնասիրել է Տավուշի մարզի Դիլիջան համայնքի Շահումյան փողոցի թիվ 34 հասցեում գտնվող մանկապարտեզի փաստաթղթերը:

Ուսումնասիրության արդյունքում պարզվել է, որ Դիլիջան համայնքի ավագանու՝ 2006 թվականի մարտի 21-ի թիվ 36 որոշմամբ՝ Դիլիջան համայնքի ղեկավարին թույլատրվել է Շահումյան փողոցի թիվ 34 հասցեում գտնվող՝ 891,1 քմ մակերեսով մանկապարտեզի մասնաշենքն անհատույց օգտագործման իրավունքով տրամադրել «Առաջինը երեխաներին» բարեգործական հասարարական կազմակերպությանը (այսուհետ՝ Կազմակերպություն)։ Դիլիջան համայնքի ղեկավարի՝ 2006 թվականի մարտի 29-ի թիվ 238 որոշմամբ՝ վերոնշյալ մանկապարտեզի տարածքն անհատույց օգտագործման իրավունքով տրամադրվել է վերոնշյալ Կազմակերպությանը:

Ուսումնասիրությամբ պարզվել է, որ մանկապարտեզի տարածքը Կազմակերպությանը տրամադրելուց հետո, այն չի օգտագործվել, իսկ իրավասու համայնքային պաշտոնատար անձանց կողմից միջոցներ չեն ձեռնարկվել գույքը համայնքին վերադարձնելու ուղղությամբ, որի արդյունքում՝ գույքը մնացել է անհատույց օգտագործման իրավունքով ծանրաբեռնված և համայնքը զրկվել է իր սեփականությունը հանդիսացող գույքը լիարժեք տնօրինելու հնարավորությունից:

Դատախազի կողմից ներկայացված հաղորդման հիման վրա՝ 2024 թվականի սեպտեմբերի 12-ին Քննչական կոմիտեի Տավուշի մարզային քննչական վարչությունում նախաձեռնվել է քրեական վարույթ։

Մինչդատական քրեական վարույթի օրինականության նկատմամբ պատշաճ դատախազական հսկողության, ինչպես նաև քննչական հետևողական աշխատանքի արդյունքում, Երևան քաղաքի ընդհանուր իրավասության քաղաքացիական դատարանի՝ 2025 թվականի ապրիլի 25-ի վճռով հաստատվել է «Առաջինը երեխաներին» բարեգործական հասարարական կազմակերպության ղեկավարի և Դիլիջան համանքի ղեկավարի միջև կնքված հաշտության համաձայնությունը:

Հաշտության համաձայնության արդյունքում՝ Դիլիջան համայնքի Շահումյան փողոցի թիվ 34 հասցեում գտնվող՝ 85 միլիոն 935 հազար դրամ շուկայականին մոտարկված կադաստրային արժեքով, 891,1 քմ մակերեսով անշարժ գույքը՝ մանկապարտեզի մասնաշենքը, վերադարձվել է համայնքին։
