Պատժից ազատվող դատապարտյալի բնակարանի վարձավճարի հատուցման և միանվագ դրամական աջակցության տրամադրման գործընթացի հստակ ժամկետ կսահմանվի. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Առաջարկվում է փոփոխություն կատարել կառավարության 2023 թ.ապրիլի 13-ի թիվ 502-Ն՝ «Պատժից ազատվող դատապարտյալներին տրամադրվող սոցիալական աջակցության ձևը, ծավալն ու տրամադրման կարգը, ինչպես նաև դատապարտյալին տրամադրվող միանվագ դրամական օգնության չափն ու տրամադրման կարգը սահմանելու մասին» որոշման մեջ: Մասնավորապես, բնակարանի վարձավճարի հատուցման և միանվագ դրամական աջակցության տրամադրման գործընթացի կազմակերպման վերաբերյալ որոշմամբ նշված ժամկետները հաճախ առաջացնում են տարընկալում, ուստի նախագծով առաջարկվում է սահմանել վերոնշյալ աջակցությունների տրամադրման գործընթացում գործողությունների կատարման հստակ ժամանակացույց։ Բացի դա, որոշմամբ դատապարտյալների վերաբերյալ տարբեր կառույցներից տեղեկատվություն ստանալու գործընթացում նրանց գրավոր համաձայնության անհրաժեշտության վերաբերյալ որևէ ամրագրում առկա չէ։ Մինչդեռ, հաշվի առնելով այն հանգամանքը, որ դատապարտյալների դիմումներում նշված գրավոր համաձայնության բացակայության պարագայում գործնականում հնարավոր չէ ստանալ անհրաժեշտ տեղեկատվություն, նախագծով նախատեսվել է, որ սոցիալական աջակցության տրամադրման նպատակով դատապարտյալի կողմից ներկայացվող դիմումը պետք է պարունակի նաև համաձայնություն՝ տարբեր կառույցներին ու կազմակերպություններին հարցումներ ուղարկելու և նրա վերաբերյալ անհրաժեշտ տեղեկատվություն ստանալու մասին։

Որոշմամբ հստակեցված չեն պատժից ազատվող դատապարտյալներին տրամադրվող միանվագ դրամական աջակցության և բնակարանի վարձակալության վարձավճարի հատուցման շրջանակներում իրականացվող ուսումնասիրության ժամանակ աջակցության տրամադրման գնահատման չափորոշիչները: Բացի այդ, միանվագ դրամական օգնության տրամադրումը կազմակերպելիս, պատժից ազատվող դատապարտյալի անհատական կարիքների գնահատման գործընթացում դատապարտյալի մոտ եկամուտների առկայության կամ բացակայության, նրա անձնական հաշվին առկա գումարի չափի վերաբերյալ տեղեկատվության ճշգրտումը գործնականում անհնար է իրականացնել, քանի որ Կենտրոնական բանկից այս տեղեկատվությունը ստանալու վերաբերյալ որոշմամբ համապատասխան կարգավորում չի տրվում: Ավելին՝ բոլոր բանկերից առանձին տեղեկատվության ստացումը պահանջում է դատապարտյալի կողմից լիազորագիր տրամադրելու և բանկում հավել յալ վճարումներ կատարելու անհրաժեշտություն, ինչը լրացուցիչ ֆինանսական բեռ է առաջացնում սոցիալական աջակցության կարիք ունեցող դատապարտյալների համար: Նախագծում առաջարկվում է դատապարտյալների բանկային հաշիվներում գումարի առկայության և դրա չափի վերաբերյալ տեղեկատվության ստացումը կազմակերպել ԿԲ-ի հետ համագործակցությամբ:

Որոշմամբ ամրագրված չէ նաև բնակարանի վարձակալության վարձավճարի հատուցման տրամադրման նպատակով դատապարտյալի բնակարան փնտրելու կարգը, ինչպես նաև այդ գործընթացում քրեակատարողական հիմնարկի գործառույթները։ Այս հարցերը ևս կարգավորվում են ներկայացված նախագծով:
