Սահմանադրական դատարանը՝ գրավոր ընթացակարգով քննելով «Հայաստանի Հանրապետության Ազգային ժողովի պատգամավորների ընդհանուր թվի առնվազն մեկ հինգերորդի դիմումի հիման վրա՝ «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի՝ Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ» գործը, հրապարակել է գործով որոշում, որը օրենքով սահմանված կարգով և ժամկետներում կհրապարակվի Սահմանադրական դատարանի պաշտոնական կայքում:

Սահմանադրական դատարանը ներկայացրել է ՍԴՈ-1776 եզրափակիչ մասը, որում ասվում է.

«... Ելնելով գործի քննության արդյունքներից և ղեկավարվելով Սահմանադրության 167-րդ հոդվածի 1-ին մասով, 168-րդ հոդվածի 1-ին կետով, 169-րդ հոդվածի 1-ին մասի 2-րդ կետով, 170-րդ հոդվածի 1-ին և 2-րդ մասերով, ինչպես նաև «Սահմանադրական դատարանի մասին» սահմանադրական օրենքի 63, 64 և 68-րդ հոդվածներով՝ Սահմանադրական դատարանը

Ո Ր Ո Շ Ե Ց .

1. «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի 5-րդ հոդվածի 1-ին մասի 5-րդ և 6-րդ կետերը՝ նույն օրենքի 24-րդ հոդվածի 1-ին մասի հետ համակցության մեջ, համապատասխանում են Սահմանադրությանն այն մեկնաբանությամբ, որ «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի հիման վրա բռնագանձման ենթակա է այն գույքը, որը ձեռք է բերվել համապատասխան պաշտոնատար անձի` պաշտոնն ստանձնելու պահից հետո։

2. «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի 5-րդ հոդվածի 1-ին մասի 1-4-րդ կետերը՝ նույն օրենքի 24-րդ հոդվածի 1-ին մասի հետ համակցության մեջ, համապատասխանում են Սահմանադրությանն այն մեկնաբանությամբ, որ բռնագանձման ենթակա է այն գույքը, որը կապ ունի համապատասխան հանցանքի հետ։

3. «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի՝ Դիմողի կողմից վիճարկվող մնացած դրույթները՝ դրանց վերաբերյալ ներկայացված հիմնավորումների շրջանակում, Սահմանադրությանը համապատասխանության վերացական ստուգման արդյունքներով համապատասխանում են Սահմանադրությանը:

4. Սահմանադրության 170-րդ հոդվածի 2-րդ մասի համաձայն`սույն որոշումը վերջնական է և ուժի մեջ է մտնում հրապարակման պահից»:
