Սահմանադրական դատարանում ավարտվել է «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին օրենքի» վերաբերյալ հարցի քննությունը, դատարանը հեռացել է խորհրդակցական սենյակ՝ որոշելու արդյոք օրենքը համապատասխանում է Հայաստանի Սահմանադրությանը, թե՝ ոչ: Դեռ հայտնի չէ, թե երբ կհրապարակվի որոշումը:

Ընդդիմությունը երկու տարի առաջ էր դիմել ՍԴ՝ վիճարկելով «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին օրենքի» սահմանադրականությունը, և այս ընթացքում ՍԴ-ն չէր կասեցրել օրենքի կիրառումը՝ թույլ տալով դատարաններում քննել ապօրինի գույքի բռնագանձման գրեթե հարյուր հայցեր։ Այդ օրենքով մինչև օրս կայացված 12 վճիռներով պետությանն է վերադարձվել ավելի քան 17 միլիոն դոլար։ Անցած տարիներին դատարան են ուղարկել 136 հայցադիմում՝ ավելի քան 527 միլիարդ դրամի, նաև՝ 270 շարժական, 1381 անշարժ գույքի բռնագանձման պահանջով:

Թվում է, թե իշխանության խամաճիկը դարձած ՍԴ-ն կկայացնի Փաշինյանին ցանկալի որոշում, բայց խնդիրը շատ ավելի խորն է։ «Քաղպայմանագրում» էլ լուռ դիմադրություն կա այս օրենքին, լոբբիստական որոշ խմբեր, իշխանական կլաններ փորձում են չեղարկել այս օրենքը՝ հասկանալով, որ եթե այսօր այն գործում է նախկինների դեմ, ապա ապագայում էլ գործելու է իրենց դեմ։ Իսկ փաշինյանական իշխանության տարբեր ազդեցիկ դեմքեր կոռուպցիայի և չարաշահումների հարցում բազմակի գերազանցել են նախորդներին։ Եվ այժմ դեմ են, որ Հայաստանում գործի «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին օրենքը»։
