Այսօր ՀՀ Վարչական դատարանը վճիռ է կայացրել Հայկական Կարմիր խաչի ընկերության (ՀԿԽԸ) ղեկավարության շուրջ ծավալված իրավական ճգնաժամի վերաբերյալ՝ անվավեր ճանաչելով ՀԿԽԸ գործադիր մարմնի փոփոխության գրանցումը: 

«Համաձայն դատարանի վճռի, 2024թ. փետրվարի 8-ին՝ գործող գործադիր տնօրեն Աննա Եղիազարյանին աշխատանքից ազատումը և ոչ օրինաչափ անձի գրանցումը նույն պաշտոնում՝ անօրինական է եղել: Մինչ այդ, նշված թեմայի հետ կապված խախտումներ էր արձանագրել նաև ՀՀ Պետական վերահսկողական ծառայությունը, ինչի մասին զեկուցվել է նաև ՀՀ Վարչապետին:  Աննա Եղիազարյանի աշխատանքից ազատելու ոչ իրավաչափ լինելու փաստը արձանագրել է նաև  ՀՀ առողջապահական և աշխատանքի տեսչական մարմինը: 

Անօրինական փոփոխության հետևանքով Հայկական Կարմիր խաչի ընկերության փորձառու մասնագետները ստիպված են եղել հեռանալ կազմակերպությունից՝ չցանկանալով աշխատել անօրինական ղեկավարության հետ, ինչը զգալիորեն թուլացրել է ՀԿԽԸ-ի գործառնական կարողությունները: 

  • Այս վճիռը շրջադարձային է ՀԿԽԸ-ի կառավարման երկարատև ճգնաժամի հանգուցալուծման և օրինականության վերականգնման ճանապարհին: Մենք արդեն մեկ տարուց ավելի է բարձրաձայնում էինք, որ Հայկական Կարմիր խաչի գրասենյակում նույնիսկ մեկ իրավասու ղեկավար չկա, և ՀԿԽԸ անունից հանդես են գալիս դրա իրավունքը չունեցող մարդիկ: Այսօր դատարանի վճիռը եկավ ապացուցելու, որ մենք ճիշտ էինք: Այս իրավիճակի արդյունքում առաջին հերթին տուժել են շահառուները, որոնք զրկվել են  ծառայությունների զգալի մասից, մեծ վնաս է հասցվել կազմակերպության համբավին:  Այժմ արդեն հնարավորություն ունենք վերականգնելու կազմակերպության բնականոն գործունեությունը և, որ ամենակարևորն է, կանխելու Ազգային ընկերությունը մասնավոր բիզնես նախագծի վերածելու փորձը, – նշել է ՀԿԽԸ նախագահ Աննա Եղիազարյանը: Տիկին Եղիազարյանը և կազմակերպությունից հեռացած թիմը՝ փաստաբան Կարեն Մովսիսյանի հետ միասին, դատական ատյաններում հետևողականորեն  պայքարեցին իրենց իրավունքների վերականգնման համար: Փաստաբանի բարձր մասնագիտական կարողությունների շնորհիվ էլ հենց հնարավոր դարձավ արձանագրել նման մի շարք արդյունքներ: 

Դատարանի վճռի արդյունքում ակնկալվում է, որ շուտով ուժի մեջ կմտնեն ՀԿԽԸ օրինական ղեկավարության լիազորությունները՝ համաձայն կազմակերպության կանոնադրության և ՀՀ օրենսդրության, իսկ ինքնահռչակ անօրինական անձինք օր առաջ կհեռացվեն կենտրոնական գրասենյակից: 

ՀԿԽԸ-ում ղեկավարության օրինականության հաստատումը հնարավորություն կտա կազմակերպությանը նորից միավորելու իր իրական մասնագետներին, վերականգնելու գործընկերների ցանցը, կրկին մոբիլիզացնելու ռեսուրսներ և ամբողջ թափով վերադառնալու մարդասիրական առաքելության իրագործմանը՝ տանելով իր աջակցող դերը Կառավարությանը մարդասիրական ոլորտում»,-հայտնում են ընկերությունից:
