«Փաստ» օրաթերթը գրում է.
Շրջակա միջավայրի նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2019 թ. նոյեմբերի 21-ի N 1667-Ն որոշման մեջ: Նախագծի ընդունման անհրաժեշտությունը բխում է 2024 թ. դեկտեմբերի 5-ին «Սևանա լճի մասին» օրենքում լրացումներ և փոփոխություններ կատարելու մասին» օրենքի նախագծի՝ ուժի մեջ մտնելու հանգամանքով:
Յուրաքանչյուր տարի շրջակա միջավայրի նախարարությունը պետական բյուջեի միջոցների հաշվին պատվիրակում է մրցույթ՝ Սևանա լճում ձկան և խեցգետնի պաշարների հաշվառման աշխատանքներ, ինչն ավարտվում է դեկտեմբերին: Հիմք ընդունելով ուսումնասիրության արդյունքները՝ տարեկան ծրագրի որոշման մեջ կատարվում է փոփոխություն՝ սահմանվում է ընթացիկ տարվա համար արդյունագործական ձկնորսության չափաքանակ: Վերջին տարիներին (սկսած 2021 թվականից) արդյունագործական որսի տարեկան քանակը գնահատվում է երկու փուլով, արդյունքում անհրաժեշտություն է առաջանում Սևանա լճում ձկան արդյունագործական որսի տարեկան չափաքանակները սահմանել երկու անգամ: Յուրաքանչյուր տարի Սևանա լճում ձկան պաշարների ուսումնասիրությունն իրականացվում է տարեկան կտրվածքով և տվյալները ստացվում են տարվա վերջ՝ դեկտեմբերին, ինչը հիմք է հանդիսանում հաջորդ տարվա ձկան արդյունագործական որսի առաջին փուլի (մինչև սեպտեմբերի 1-ը) չափաքանակ հաստատելու համար։
Միևնույն ժամանակ, ամառային շրջանում իրականացված գիտական հետազոտության տվյալները ձեռք բերելուց հետո սահմանվում են արդյունագործական որսի 2-րդ՝ աշնանային որսաշրջանի չափաքանակները (մինչև նոյեմբերի 15-ը)։ Սա էլ ենթադրում է արդեն ընթացիկ տարում հաստատված որոշման մեջ լրացումների կամ փոփոխությունների իրականացում։ Չափաքանակների հաստատումից հետո որսի գործընթացը սահմանված կարգով իրականացնելու համար տրվում է հայտարարություն, հավաքագրվում են հայտերը, մշակվում և սահմանված կարգով կնքվում է Սևանա լճում արդյունագործական որսի պայմանագրեր, ինչը նույնպես ժամանակատար գործընթաց է: Տարեկան ծրագրի շրջանակներում այս գործընթացն իրականացնելն առաջացնում է խոչընդոտներ նաև բուն որսի իրականացումն իրատեսական ժամկետներում կազմակերպելու տեսանկյունից։ Այդ պատճառով տարեկան ծրագրում միջոցառման կատարման նկարագրում նշվում է, որ դրա կատարումը հնարավոր է ապահովել տարեկան ծրագրի հաստատումից հետո՝ հիմք ընդունելով այդ կետի կատարման համար անհրաժեշտ տվյալների ստացումը։
Օրենսդրական խնդիրներից խուսափելու համար օրենքի 13-րդ հոդվածի 3-րդ մասի համապատասխան կետում կատարվել են փոփոխություններ՝ հանելով այդ խնդրահաույց կետը տարեկան ծրագրով սահմանելու պահանջից։ Մասնավորապես առաջարկվող փոփոխությունների համատեքստում օրենքի 15-րդ հոդվածով կառավարության լիազորությունները լրացվել են նոր կետերով:
Նախագծով առաջարկվում է Սևանա լճում յուրաքանչյուր տարվա համար սահմանել ձկան և խեցգետնի արդյունագործական որսի չափաքանակները և ժամկետները, արդյունագործական որսի կազմակերպման պայմաններն ու պահանջները: Նախագծի ընդունման արդյունքում նաև կհեշտացվի հայտերի ընդունման և պայմանագրերի կնքման գործընթացը։
